When you make an offer to purchase a property, make sure that you and the seller agree on an occupation date. The term โ€˜occupationโ€™ refers to the date on which a seller is obliged to give vacant possession of the property to a purchaser. It could be on the date of registration or another pre-determined date before or after registration. The parties must agree to the occupation date as well as the occupation rental amount in the offer to purchase document. Once agreed, the parties are contractually and legally bound to this date. The occupation date can only be amended by agreement in an addendum. Let us assist you. Call us now on 078 126 4201.

Stop! Listen! Did you know? To purchase a property and create a valid and enforceable contract, you will be required to make a written offer to purchase the property, which in turn will have to be accepted by the seller in writing. Are you aware that agreements of sale of immovable property are not valid if they are signed electronically? It has to be signed in 'wet ink' with a pen. The offer itself will become the contract on acceptance by the seller. Reach out to us today at [email protected] and let's talk about your next property transaction.

Distinguishing between fixtures and fittings in the sale of a property may sometimes lead to conflict and should be addressed when the offer to purchase a property is made. It is advisable as the buyer to insert an extensive list of fittings in the purchase agreement that you wish to be part of the sale. As the seller, be pro-active. Have a list of items that you wish to remove ready and hand it over to the estate agent when you list the property. To avoid any misunderstandings and to help make the entire process an amicable experience, send us a message at [email protected].
