When you consider the impact on your family, your Estate and your legacy when you pass away without a Will in place, you’d think this would be a top priority – and yet we still see only 1 in 4 South Africans passing away with a valid Will in place.

In a recent survey we asked people why they haven’t gotten their Wills in order. The results were astounding.

➡️ 43% of respondents said: “I just haven’t got around to it.”

➡️ 27% said: “I’m not sure where to get my Will done.”

➡️ 21% said: “I think it might be expensive to get a Will.”

➡️ Only 9% of respondents said they think they don’t need a Will.

REPEAT …43% of respondents said: ‘I just haven’t got around to it’

Make sure that your family is protected financially should anything happen to you.

It will only take a few minutes to protect your legacy today.

Separation/Divorce of parents can result in a dispute over parenting rights. (A bitter parent denying the other parent access to the child)

According to the law, it is expected that there should be a kind of a parenting plan which is all about parental rights and responsibilities agreement.

If the parenting plan does not work, we make an application to the High Court where an order will be made in favour of the best interests of the child.

Dismissals must be regulated by legislation and protect the interests of both parties – an employer must be able to run their businesses effectively, but an employee must be treated fairly.

The main provisions for dismissals are found in S186 and S188 of the LRA, and in the CODE: Dismissals.

The LRA only forbids dismissals which are unfair. This is specifically where the reason for the dismissal infringes upon an employee’s basic rights.

The LRA stipulates that a fair dismissal must comply with substantivefairness (the reason behind the dismissal must be fair) and it must comply with fair procedure.

There are only three reasons an employee can be dismissed:

1) Misconduct
2) Incapacity (work performance with disability/illness/incapacity)
3) Operational Requirements
