Why should employers have Employee Codes of Conduct?
The Labour Relations Act recognises 3 grounds for lawful dismissal:
conduct of the employee, capacity of the employee and operational requirements of the employer.
This Act states that when considering whether a dismissal for misconduct was unfair it should be considered whether or not the employee contravened a rule in the workplace.
So why is an Employee Code of Conduct important? Because how else will employees know what rules are applicable in the workplace?

Do you know how many types of leave an employee is entitled to?
SEVEN!
That’s right, there are seven types of leave – annual leave, sick leave, family responsibility leave, maternity leave, adoption leave, parental leave and commissioning parental leave.
In terms of the Basic Conditions of Employment Act, one of the particulars that must be in writing relating to the employer-employee relationship is the leave an employee is entitled to.

Are you an employer? Do you have up to date and comprehensive employment contracts for your employees? Why do you need employment contracts? In terms of Section 29 of the Basic Conditions of Employment Act an employer must supply an employee with certain particulars in writing.

Some of these particulars are:
• Full names and address of the employer;
• Name and occupation of the employee;
• Place of work;
• Date on which employment began;
• Hours and days of work;
• Wage;
• Rate of pay for overtime;
• How frequent remuneration will be paid;
• Any deductions to be maid from the employee’s remuneration;
• Leave the employee is entitled to;
• Period of notice required to terminate employment;
• If it is a fixed term employment, the date of termination;
• A list of other documents that form part of the contract of employment.

Did you know that a company is obligated to keep and maintain:
•The memorandum of incorporation;
•Record of the company’s directors and details of any person who has served as a director;
•Copies of reports presented at an annual general meetings;
•The annual financial statements;
•The accounting records;
•Notices and minutes of all shareholders meetings and the resolutions adopted; and
•Minutes of all meetings and resolutions of directors.
These records and documents must be kept at the company’s registered address, in written format and for a period of 7 years.

Is the following information available on your website:
Your company’s registration number and registered address and the names of the office bearers?
The terms applicable to the transaction and agreement like the guarantee or warranty?
The manner which customers can access and maintain the record of the transaction?
The return, exchange and refund policy?
The security procedures and privacy policy of that supplier in respect of payment, payment information and personal information?
The customer’s cooling-off period consumer rights?
If you answered no to 1 of these questions, it is likely that your e-commerce website does not comply with the Electronic Communication and Transactions Act.
Non-compliance means that your customer can cancel the transaction within 14 days of receiving the goods purchased.
Compliance can be obtained by ensuring that your website has the necessary and required terms and conditions, privacy policy and return policy in place.

Do you have employment contracts in place? Does it comply with the Basic Conditions of Employment Act (BCEA)?

We want to share a few “did you know” facts:
Did you know that the BCEA was amended to include Parental Leave, Adoption Leave and Commissioning Parental Leave?
Did you know that it is unlawful for an employer to insist that an employee produces a medical certificate or sick note for an absence on a Friday, or on a Monday, or on the day before or the day after a public holiday?
An employee, to be entitled to paid sick leave, must present a medical certificate if he is off sick for more than 2 consecutive days (in other words, 3 days or more).
Did you know that annual leave cannot be exchanged for cash or payment?
Section 20(11) prohibits an employer from paying an employee for annual leave except upon termination of employment.
