This week there was an amazing judgement in the Equality Court which found that derogatory comments made against people of Chinese origin were regarded as hate speech and the court ordered the people who made the comments to apologise, pay damages and remove the comments.

South Africa guarantees equality and dignity for all persons so always read what you post and share on Facebook.

Exciting news! Sign language will soon become one of the official languages in South Africa. A bill has been published for comment to amend Section 6 of our Constitution to include South African sign language. Now everyone has access to the law equally.

In a recent court judgement in the Gauteng High Court, Pretoria, a mother and grandmother were sentenced to 30 days imprisonment suspended on condition that they allowed the father contact with his child.

In South African law, both parents are equal guardians of the minor child but if the parents separate, the child or children are still entitled to have contact with both their parents.

In this case, both the mother and grandmother were frustrating the fathers rights of contact and the court would not allow that as it was not in the best interest of the child.

On 28 January 2022, President Cyril Ramaphosa signed three legislative Bills into law, in an attempt to strengthen South Africa's response to gender-based violence (GBV), namely: the Criminal Law (S*xual Offences and Related Matters) Amendment Bill; the Criminal and Related Matters Amendment Bill; and the Domestic Violence Amendment Bill.

These laws, amongst other things, do the following:
1) Expand the scope of the National Register for S*x Offenders (NRSO) to include the particulars of all s*x offenders and not only s*x offenders against children and persons who are mentally disabled;
2) Expand the list of people who are to be protected by anti-GBV legislation;
3) Increase the periods for which a s*x offender's details must remain in the NRSO before they can be removed;
4) Further regulated the granting and cancellation of bail; and
5) Add additional regulation of sentences of offences committed against vulnerable people.

Furthermore, the amended legislation now provides for 'controlling behaviour', 'coercive behavior', 'elder abuse' and 'exposing a child to domestic violence' as forms of domestic violence.

If you, or anyone that you know is suffering from domestic violence and wishes to apply for protection, please reach out to and a lawyer will be in contact with you shortly.

When doing good benefits the community leaders. We spent two days equipping community and religious leaders to tackle the very complex problems surrounding child maintenance, foster care, adoption and registration of births.

Well done to the community of Wentworth for putting your children first.

Welcome to 2022!

Road Traffic Act

We start the year with a recent court judgement which is currently in the news where the AARTO amendment act was declared unconstitutional.

AARTO is the legislation that enables the metropolitan police services to impose fines and penalties for traffic infringements. An AARTO infringement notice is given when one is caught speeding, for example.

At this stage there is no news as to what will happen to all traffic fines issued in terms of this legislation. Needless to say that the point was well made that the traffic laws did not make the roads safer as was intended.

Parliament now has to go back to the drawing board to draft new legislation. Let’s see what happens.
