The Consequences of a Admission of Guilt Fine i.t.o the Disaster Management Act 2002

Section 57 of the Criminal Procedure Act 1977, (Act 51 of 1977), affords an accused or detained person the opportunity to pay an admission of guilt fine for minor offences. The purpose is to prevent the overburdening of South African Courts with trivial matters.

It is important to take note that the payment of admission of guilt fines, paid at a police station or at any local authority, will result in a permanent criminal record. The Act specifically states that: “… the accused concerned, shall be deemed to have been convicted and sentenced by the court for the offence in question.”

Should you be arrested for contravening the provisions of the Disaster Management Act 2002, (Act 57 of 2002), refrain from paying an admission of guilt fine, which will result in a permanent criminal record.

Admission of Guilt (AOG) fines ranging from R500 – R5000 are being issued by the South African Police Service for contravening some of the regulations as set out in the Disaster Management Act (DMA).
