DIRECTORS AND PARTNERS

Anthony Wilton

Anthony Wilton is currently a director and partner at Anthony Wilton, Thinane Inc. completed and obtained his B.luris and L.L.B Law degrees from the University of South Africa (UNISA) in 1992. Thereafter he became a prosecutor where he obtained valuable litigation experience. In 1994 he was appointed and served a s a Magistrate for a period of two years. Anthony completed his articles after leaving the Justice Department and became the founder of Anthony Wilton Attorneys in April 1998. In May 2010, Anthony obtained his L.L.M Master's Degree in Corporate Law from the University of Johannesburg (UJ). Anthony takes great pride in upholding the company values, vision and mission and always leads by example. He is driven to provide service excellence and quality legal services at Anthony Wilton, Thinane Inc. Anthony specializes in commercial, company and surrogacy application, as well as general litigation matters. Dominic Thinane

Dominic Thinane, or "Don" as he is known, is currently a director and partner at Anthony Wilton, Thinane Inc. Don was previously employed as a Court Interpreter from 1964 to 1971. During his employ, he was offered an incentive to pursue a legal career as an attorney which he accepted and attended to successfully. Don went on to obtain a B.Proc Law degree in 1976 from the University of the Northwest and thereafter his L.L.B Law Degree in 1980 from the University of the Witwatersrand (WITS). Don was the founder of D Thinane Attorneys. Don has gone on to pursue his further studies and completed his Masters (L.L.M) Degree in Human Rights Law in 1996 which was obtained from the University of Pretoria (UP). Don has accumulated several years of experience in litigation, during the course of which he developed an affinity for Environmental Law, and subsequently obtained a Master's degree in Environmental Law. Roberto Small

Roberto Small is an admitted attorney at Anthony Wilton, Thinane Inc. He completed his articles in 2007 and was admitted as an Attorney in February 2008. He has a Bachelor of Law (LLB) obtained from UNISA. He specializes in all aspects relating to litigation and has developed a wealth of experience in motor vehicle accident claims whilst spending 5 years as a legal advisor in the insurance industry, which included working at Ernest & Young Consortium. Roberto's area of expertise lies in Road Accident Fund claims, however his experience also extends to providing legal advice with regard to short term insurance and family law (mediation, maintenance & divorce). Roberto began working for Anthony Wilton, Thinane Inc. in November 2014. Kenneth Smal

Kenny is an admitted attorney. He obtained a BProc LLB from the University of Johannesburg in 1986. He completed his articles in 1988. He thereafter prosecuted for the Department of Justice stationed at Alberton Magistrates Court until 1991. He was then admitted as an attorney and joined the state attorney's office until 1995. He then joined Botha and Sutherland as a professional assistant until 1997. He thereafter started practicing for his own account until October 2013. He was forced to close the practice as he became ill. After he regained his health he joined Anthony Wilton, Thinane Inc. as an associate in February 2015. Kenny specializes in civil litigation, collections and general practice. He effectively has 27 years of legal experience behind his name. Angela Howson

Angela obtained her BA and LLB degrees from the University of the Witwatersrand in 1997 and 2000 respectively. She worked at the Public Defender's office as a candidate attorney whilst completing her articles. In January 2003 she was admitted as an attorney by the High Court of South Africa and subsequently practiced as an attorney with a particular interest in property law. Subsequently, Angela was admitted as a Conveyancer and Notary in 2006. She currently heads the conveyancing department at Anthony Wilton, Thinane Inc. CANDIDATE ATTORNEYS

YES, YOU DO NEED A WILL

Do you often think that your estate is not big enough and you do not need to bother making out a Will? Please think again!

We have a lot of experience dealing with “smaller” estates. By this we mean an estate which has a total value of less than R250 000.00 . Estates of this size are administered under Section 18(3) of the Administration of Estates Act and a Letter of Authority is issued as opposed to a Letter of Executorship. For an estate this size, no Liquidation and Distribution Account is required and there is no advertising of the estate.

The estates which we deal with at this value are typically estates of elderly people who acquired an “RDP” house. This immovable property needs to be dealt with on their death. We often find that the family continues to live in the house and when they eventually decide to either sell it or give it to one of the family members, the deceased estate was never reported to the Master of the High Court. This is usually the stage at which the client will approach us.

If a person has not left a Will (in other words, they have passed away intestate), either the surviving spouse or one of the children of the deceased is likely to be appointed as the Master’s Nominated Representative (in the case of a Section 18(3) estate). However, before such an appointment is made, all the next-of kin of the deceased must sign an affidavit to be submitted to the Master’s office consenting to the appointment. It is often extremely difficult to locate all the next-of-kin, especially if a sibling has passed away and the family has lost contact with the children of that sibling.

In short, it becomes a very frustrating process for the family but one which must be followed in order to deal with the property. The longer it is left, the more difficult it becomes to transfer the property.

All this can be avoided if you leave a valid Will stipulating what should happen to your property in the event of your death and who should act as the Executor of your estate. A Will can be short and sweet, it need not be a long and complicated document, but it must adhere to particular formalities and you should therefore seek the assistance of a professional to ensure that you Will is valid.

EMPLOYERS V CCMA IN RELATION TO UNFAIR DISMISSALS

One of the biggest conundrums faced by employers is the concept of unfair dismissal in the workplace environment. Often employers will dismiss employees and face the wrath of the law in the aftermath of such decision. The Labour Courts have become most intolerant of employers failing to follow their own disciplinary policies and procedures and who cannot then justify their decision of dismissal based on the merits in the particular circumstances which further place the employer in a very weak position.

Section 188 of the Labour Relations Act 66 of 199, places the onus on the employer to prove that the dismissal was not only substantially fair but also procedurally fair.

The case of Riekert v Commission for Conciliation Mediation and Arbitration and Others (JR686/03) [2005] ZALC 90; [2006] 4 BLLR 353 (LC) is of particular significance relating to the above discussion. In this case, Riekert was dismissed for gaining access to confidential information without authorization and for the deterioration of the good relations with company management. Riekert further took the employer to the Commission for Conciliation Mediation and Arbitration (CCMA), where the dismissal was upheld by the arbitrator. Riekert then took the decision of the arbitrator on review to the Labour Court, where the honourable judge made the following remarks in relation to the decision of the arbitrator:

The honourable judge could not find clarity as to how the arbitrator arrived at the decision that the dismissal was substantially fair as there was a conflict between, on the one hand, the arbitrator recognizing the very extensive disciplinary code and procedures which the employer had in place and which was included in the contract of employment but which was not adhered to and on the other hand, that the very extensive disciplinary code and procedures was merely a guideline for the employer and the dismissal was found to have complied with the requirements of natural justice.

While the honourable judge agreed that the disciplinary codes and procedures were merely a guideline, this does not entitle employers to deviate from such as and when they so desire and that the arbitrator had failed to apply his mind to the evidence in finding that the dismissal was to be seen as substantially fair. The arbitrator did not take into consideration the six months that had lapsed between the time the alleged incident occurred and the time the charges were laid against the employee and the fact that the employee was further denied the opportunity to call witnesses in his defence.

The Labour Court found the dismissal to be both procedurally and substantively unfair, and the employer was ordered to pay R10 000.00 (Ten Thousand Rand) to the employee as compensation with interest, as well as the legal costs incurred by the employee.

The case is of great significance to employees as emphasis is placed on valuable lessons that can be learned on how to manage disciplinary codes and procedures internally such as:

• Employers should follow their own disciplinary codes and procedures;
• Employers should notify employees of the charges intended to be laid against them, even if this may cause unnecessary delays;
• Employers should allow employees to be witnesses to their own disciplinary hearing;
• Employers should prepare all evidence thoroughly before attending an arbitration hearing.

Important Changes to the Sectional Title Act – it will affect you

The Sectional Titles Schemes Management Act (STSMA) will affect the way in which the body corporate of each sectional title scheme manages that scheme. Various sections of the Sectional Title Act as we know it will be repealed and replaced with sections of the new STSMA.

Examples of these changes include:

The establishment of a mandatory reserve fund in order to pay for maintenance and repairs to the scheme in an attempt to avoid the imposing of special levies as is the current norm.
The drafting of a maintenance plan for the following 10 years. This plain will need to include the current condition of “major capital items”, which items will have to be maintained, the costs of maintenance and the life span of the maintenance and repairs.
Body corporates will need to procure additional fidelity insurance to cover the loss of money as a result of fraud or dishonesty.

You should not be surprised to see that your monthly levies may need to be increased to cater for these changes and to ensure that your body corporate does not fall foul of the STSMA.

The STSMA will work hand-in-hand with the new Community Schemes Ombud Service Act (CSOSA). It is envisaged that this Act will allow for more cost-effective dispute resolution. The current costs of litigating prevents a lot of body corporates from pursuing errant tenants. It is hoped that the new Ombud will assist body corporates and tenants to resolve disputes without either party incurring exorbitant costs.
