Burnout in the Deceased Estates Profession: It’s Time We Talk About It

Working in deceased estates can only be described calling —whilst some of us stumble into this area of legal practice staying there requires empathy, precision, and patience. But let’s be honest: it can also be emotionally draining and mentally exhausting. The truth is our clients are forced to engage with us due to a loss of a loved one or someone of significance in their lives and very often the grief and pain they experience gets channelled our way in the form of anger , annoyance and irritation. Couple this with the less than adequate experiences with the Master of the High Court- it’s a quite a situation to navigate for the fiduciary professional!

Often, we give so much of ourselves that we forget to check in with… ourselves.

If you’re feeling disconnected, fatigued, irritable, or overwhelmed — you may be experiencing burnout.

What you can do for yourself in this demanding space:

Acknowledge the Emotional Weight: Every estate file is more than paperwork — it’s someone’s legacy. But you don’t have to carry every burden alone. Compassion fatigue is real, and it’s okay to pause and reset.

Protect Your Time: Block off time for admin, catch-up, or even quiet breaks. Not every moment has to be client-facing or crisis-managing.

Lean on Your Team: You’re not a silo. Collaborate, delegate, and debrief. A strong team doesn’t just share the work — it shares the emotional load.

Speak Up When Overloaded: Silence often leads to burnout. Ask for help, flag heavy workloads, and set professional boundaries with empathy and professionalism.

Prioritise Your Mental Health: Whether it’s formal therapy sessions, coaching, or simply talking to a colleague — your well-being deserves attention too.

General Tips to Guard Against Burnout (for everyone):

Rest Without Guilt — You don’t have to “earn” your rest. It’s a basic need, not a reward.
Microbreaks Matter — A walk, deep breaths, or a cup of tea can shift your whole mood. Step away from your desk and get sum sunshine whenever you can.
Say No Kindly, but Clearly — Overcommitting is unsustainable. Protect your peace.
Celebrate Small Wins — Progress isn’t always a major milestone. Value the steps you do take.
Create Space for Joy — Outside of work, make time for things that make you feel alive, not just productive.

You can’t pour from an empty cup. In a profession built on care, remember to care for you too.
