One of the most common disputes in sectional title schemes is about maintenance: who fixes what, and who carries the cost.
The law defines three categories of property. Sections are individually owned, defined by the median line through the unit's floors, walls, and ceilings. Owners are responsible for everything within that boundary, including internal fixtures, household contents, and geysers, even when installed in a roof space or on common property.
Common property, including roofs, driveways, gardens, lifts, and shared infrastructure, is maintained by the body corporate. Exclusive-use areas such as parking bays or storerooms are common property designated for a specific owner's benefit, with maintenance costs recovered from the holder.
When these boundaries are understood and applied correctly, disputes reduce and responsibilities are clear.
