A reportable judgment for our client in the Labour Court.

After a strike over wages and working conditions, the employees called off the strike and asked the court on an urgent basis to end the employer's lockout and let them return to work. The court dismissed the application.

The strike had ended, but the underlying dispute had not been resolved. The court found the employer was entitled to continue the lockout until it is. Whether the employer used replacement labour also had no bearing on whether the lockout was lawful.

Higgs Attorneys acted for the employer. We advise employers on strikes, lockouts and collective bargaining.

A result for our clients in the High Court.

The court dismissed an application for the dissolution of solvent family companies, with each party ordered to pay their own costs.

Disputes inside a family business are rarely only about money. The companies, the trust and the family are often tied together, so the route a dispute takes matters.

Another result for our client in the Labour Court.

The court reviewed and set aside an adverse arbitration award. The dismissal dispute now goes back to the bargaining council for a fresh hearing before a different commissioner.

An arbitration award is not always the final word. Where the reasoning or the process falls short, the Labour Court can set it aside.

Another win for our client in the Labour Court.

The review application was dismissed and the arbitration award upheld in full: reinstatement with retrospective effect, and costs awarded on the attorney and client scale.

Retrospective reinstatement compounds with every month a matter runs, so a review that fails costs a great deal more than the legal fees. Costs on the attorney and client scale are also not routine in this court.

Negligence or gross negligence? The Labour Court has drawn the line.

Higgs Attorneys Inc. successfully represented the applicant in this matter before the Labour Court in Johannesburg. The judgment is reportable and has been published by SAFLII.

An employee with 26 years of unblemished service was dismissed following a VAT audit verification. The Court found she had performed the audit but had not recorded the findings, and held that those are two different failures.

Two factors weighed against the employer. The employee was never suspended and continued performing the same duties, and the employer's own evidence confirmed the trust relationship remained intact. SARS suffered no financial loss.

The dismissal was found substantively unfair. The employee was reinstated retrospectively with a written warning.
