what you need to know and what not to do:
1. Never sign any settlement agreement if you are not sure.
2. If you feel you being bullied by the Commissioner to settle, you have the right to refuse, Commissioner has nothing to do with it and as an employee you have everything to do with it.
3. If you sign, you must know you will not come back and claim you were forced to, nothing compels you to do so.
4. Get some advice, it doesn't have to be an expensive one from lawyers, it could be a union or the CMO or the Senior Commissioner if unsure.
After Bing inundated by numerous requests to assist people to set aside settlement agreements signed under auspices of the CCMA, I think it's high time settlement agreements are having a clause of withdrawal within 7 days hayikhona.
