A good number of people pass away without executing a valid Will, intestate, which is not advisable. Dying intestate poses the risk of the deceased estate being administered in a manner that is against what the deceased would have preferred. It also raises the possibility of legitimate and illegitimate ‘heirs’ battling it out (sometimes for years) in the Courts. Minor’s inheritance will be paid to the State (Guardian’s Fund) in the event that no guardians identified. Of Medical Expenses and Medical Aids – RAF’s New Directive irks Medical Aids

On 23 August 2022, the Pretoria News (accessed on IOL platform) reported that the Road Accident Fund (RAF) published a circular of a new directive to the effect that it will no longer pay claims for medical expenses which are covered by medical aids/insurers. The news was met with disapproval by most medical expenses insurers, with Discovery setting in motion proceedings to challenge the new directive in the Courts. The Bill of Rights forms a fundamental part of the Constitution of the Republic of South Africa, Act 108 of 1996, and occupies an integral place in our judicial system. The interaction between legal subjects in society often results in a situation whereby the exercise of rights by one party competes against the rights and interests of another party. This realisation, it is thought, was the reasoning behind the promulgation of principles provided in Section 36 of the Constitution. ROAD ACCIDENT FUND CLAIMS – BE CAREFUL OF THIS TOO

Whenever a party brings an action for damages before the court, not only is there an onus to prove the basis (cause of action)upon which such claim is premised on, but also how the quantum of the damages was arrived at. Sometimes a plaintiff may file their claim or action without adequate evidence to substantiate the damages, which may be rectified later by amending the particulars of claim. However, where the plaintiff neglects the duty to substantiate the claim and/or damages, it may run the risk of being dismissed. This was the case in the matter of Mdluli v Road Accident Fund.
