R2 for toilet at Garages:

1. National Building Regulations (SANS 10400)
Under the National Building Regulations and Building Standards Act, specifically Part S (Facilities for Persons with Disabilities), buildings that serve the public are required to provide accessible sanitary facilities.

* Mechanical Barriers:
The use of R2 coin-operated turnstiles creates a physical and financial barrier. Legally, these facilities must be "accessible." If a turnstile prevents a person with a disability, an elderly person, or someone in an emergency from entering, the building may be in violation of SANS 10400-S standards for universal access.

* Public Access:
Since filling stations are categorized as businesses providing essential services to travelers and motorists, they are generally required by their operating permits to provide certain public amenities.

2. The Consumer Protection Act (CPA)
The Consumer Protection Act No. 68 of 2008 protects your right to fair, reasonable, and just terms in the marketplace.

* Unfair Business Practice:
If you are a customer (buying fuel, coffee, or snacks), it can be argued that charging an additional fee for a basic human necessity is an "unjust" practice.

* Implied Service:
When a garage markets itself as a "One Stop" or "Service Station," there is an implied consumer expectation that sanitation is part of the service provided to motorists.

3. Constitutional Right to Dignity and Sanitation
The South African Constitution and the Water Services Act recognize access to basic sanitation as a fundamental human right.

* Right to Dignity:
Section 10 of the Constitution states that everyone has inherent dignity. Denying someone access to a toilet because they lack a specific R2 coin can be seen as a violation of their dignity, especially in medical or urgent situations.

* Human Rights Commission:
The SAHRC has previously noted that charging for sanitation in public-facing spaces can unfairly discriminate against the poor and those in vulnerable physical states.

4. Franchise and Industry Standards
Most garages are franchises of major brands like Shell, BP, Engen, or Sasol.

* Franchise Agreements:
Almost all major fuel brands have strict internal policies that mandate free and clean restroom access for customers.

* The "Maintenance" Defense: Garage owners often claim the R2 is a "service fee" for cleaning. However, major fuel brands usually provide a budget or expect the shop's profits to cover these costs. If you report a "pay-to-enter" turnstile to the brand’s head office, they often intervene and force the owner to remove the charge because it damages the brand’s reputation.

Practical Resolution
If you are faced with a mechanical turnstile and do not have a coin:
* Request Access:
Legally, the manager should provide a "token" or open the gate for you upon request, especially if it is an emergency or you are a paying customer.

* Report to Head Office:
Take a photo of the turnstile and send it to the fuel brand’s customer service email.
This is usually the most effective way to have the charge removed.

* National Consumer Commission:
You can lodge a complaint regarding unfair access to facilities at a place of business.
