This Womenโ€™s Month, weโ€™re reflecting on a landmark Constitutional Court judgment that changed the legal protection afforded to domestic workers in South Africa.

In Mahlangu and Another v Minister of Labour and Others, the Constitutional Court considered the exclusion of domestic workers from the protection of the Compensation for Occupational Injuries and Diseases Act (COIDA).

At the heart of the case was more than legislation. It was about dignity, equality and the recognition of domestic work as real work deserving of legal protection.

The judgment also reminds us of the important role that women continue to play in challenging inequality and shaping the law.
