On 24 February 2026, the Constitutional Court delivered an important judgment: employees cannot claim constructive dismissal simply because they fear their working environment ๐ฎ๐ช๐จ๐ฉ๐ต become intolerable.
The Court emphasised that:
โข Working conditions must be truly โintolerableโ, not just unpleasant or frustrating.
โข Employees must first use internal grievance procedures.
โข Resignation must be a last resort.
This judgment sets a high threshold for constructive dismissal claims and reinforces the importance of exhausting internal remedies before resigning.
