🌳 Building generational wealth? A discretionary family trust might be the answer. Or it might cost you.

A trust is a legal structure where a trustee holds property or assets for your family. Done right, it is one of the most powerful tools for protecting wealth across generations.

Trust assets do not form part of your estate when you die. They stay in the trust, for the benefit of your family. That can mean significant estate duty savings.

But there are real traps.

The Do's
✅ Get legal, tax and financial advice before you set up a trust or buy property in one.
✅ Read your trust deed carefully. Know exactly what trustees can and cannot do.
✅ Keep proper records of transactions, resolutions and distributions. SARS may ask for these.

The Don'ts
❌ Don't ignore the tax. Buying in a trust is not always the right move. If you are buying your primary residence, the first R3m in capital gains on sale is tax-free in your personal name. That exemption falls away in a trust.
❌ Don't mix trust assets with personal assets. It undermines the protection the trust provides.
❌ Don't use trust property outside the trust's stated purpose.

A trust is powerful. But it only works if it is set up correctly and managed properly.
