Not every commercial debt dispute needs to end in litigation or liquidation. And for businesses where the debtor is also a long-standing client or supply chain partner, escalating too hard too fast can cause more damage than the outstanding amount. Negotiated repayment plans, when structured correctly and documented in a formal acknowledgment of debt, do two things simultaneously: they reset the prescription clock and create an enforceable agreement that can be acted on if the debtor defaults again. The acknowledgment of debt is critical – a verbal agreement or email thread is not enough. Strauss Daly Inc. structures payment arrangements that recover your cash flow on a clear timeline while keeping the option of enforcement open.

The South African Reserve Bank's growing focus on recovery plans for material financial institutions reflects a broader concern: unchecked bad debt doesn't just hurt individual lenders, it poses systemic risks to the broader economy. For banks and large creditors, having a legally sound and proactive debt recovery strategy is no longer optional risk management. It's a regulatory expectation. Strauss Daly partners with financial institutions to develop and execute recovery frameworks aligned with SARB guidance, the NCA, and insolvency legislation.

A writ of ex*****on against movable property requires a sheriff to physically attach and sell assets, which can take months and produce unpredictable returns at auction. A garnishee order, by contrast, intercepts money already in motion. It attaches directly to a debtor's bank account or salary, producing regular, predictable payments without the logistics and delays of asset sales. For SMEs managing cash flow through South Africa's winter slowdown in 2026, the difference between these two mechanisms is the difference between recovering working capital this quarter or waiting until next year. Emoluments attachment orders work similarly for individual debtors with stable employment, creating a structured recovery that continues until the debt is settled. Need cash flow from a judgment? Our legal team will identify the fastest enforcement route.

Obtaining the judgment against a debtor is a significant legal milestone, but the money doesn't arrive with the court order. Enforcement is what turns the judgment into actual cash flow. Writs of ex*****on, garnishee orders, and emoluments attachment orders are the mechanisms that compel payment, and they need to be deployed immediately after judgment is granted, not weeks later when the debtor has had time to move assets, empty accounts, or restructure their affairs. The businesses that recover effectively treat enforcement as the next step. Have a judgment sitting unused?

Many businesses hesitate to escalate unpaid debts out of fear of damaging relationships. However, once a debtor consistently delays payment beyond 60 days, leniency often works against you. In South Africa’s tight credit market, debtors prioritise firmer creditors first. Prolonged informal chasing increases exposure to overdrafts, interest costs, and eventual write-offs.

Protect your cash flow before delays become losses: https://tinyurl.com/mrz5n4nx

One of the most persistent challenges in South Africa's insolvency landscape is directors delaying action until rescue is no longer viable. This pattern continues to undermine the effectiveness of business rescue provisions. Under Chapter 6 of the Companies Act, directors have a legal obligation to act when financial distress is reasonably foreseeable. High-profile cases highlight just how complex and consequential these situations can be.

Insolvency occurs when a business or individual can no longer meet their financial obligations. The main test for declaring insolvency is when liabilities (debts) exceed assets (what you own). While the inability to pay bills is often a clear sign, it's not the only indicator. Insolvency can also be identified through a business's inability to settle outstanding debts, or when a company is facing judgment orders that it cannot fulfil. If you find yourself in financial distress, it's important to assess your situation and seek professional advice before the situation escalates. Concerned about insolvency?
