WHY HAVE A WILL?
Many people assume that their family or spouse will automatically inherit everything they have in the event of their death.
This however is not true, because dying without your Last Will and Testament can result in long delays in the finalization of your estate. It causes more grief and hardship for those left behind and could also mean extra and unnecessary costs.
Having a Will ensures that your wishes are honoured after you pass away, and that your loved ones are protected according to your Last Will and Testament. A will is arguably one of the most important things you can do for yourself and your family. Not only can a will legally protect your spouse, children, and assets, it can also spell out exactly how you would like things handled after you have passed on.
Procrastination and the reluctance to accept death as part of life are common reasons for not having a will. Sometimes the realization that wills are necessary comes too late – such as when an unexpected death or disability occurs. To avoid the added stress on families during an already emotional time, it is wise, necessary and important to meet with an Attorney to assist you. An attorney is skilled and will draft your Will in terms of the laws in order to prevent your will from being rejected due to unnecessary clauses.

We advise that anyone who attempt sales of these items and if caught will face the consequences of the law. The public is urged to report any illegal activities to their nearby POLICE STATION OR CALL 10111.

WILLS AND ESTATE PLANNING
The last months has seen a major change in the way we live our lives. The demand for Wills has surged during the Covid-19 pandemic which is understandable in the midst of this grave health crisis.
As attorneys we are able to give advice on drafting and executing of Wills. There is no sense delaying any longer when we can help you with any contentious intricacies of this important process.
Our offices are offering FREE WILLS to the public, in order to obtain a free will you can contact our offices to make an appointment.
Due to the restriction of movement our offices are amenable to drafting of wills via email. All wills should be signed by using a black ink pen and witnessed by two independent individuals over the age of 18. ALL WILLS MUST BE DATED.

Further note that a beneficiary cannot be a witness to a will. We emphasize on the safe keeping of the Original WILL. Should it be misplaced or destroyed it will be taken that you passed on without leaving a WILL.
WHAT HAPPENS IF YOU DIE WITHOUT A WILL.
Should you not have a will, it simply means that you passed on without giving instructions to who should carry out the duties in the absence of you and who should inherit from your Estate.
There will be no executor appointment by you and the choice of nominating an Executor in your absence is challenging

LOCKDOWN REGULATIONS REGARDING SHARED PARENTHOOD
On the 07 April 202, Social services Minister Lindiwe Zulu issued an Amendment to the directions regarding the movement of minor children between co holders of parental rights and responsibilities and rights as a caregiver during the National Lockdown. A child is now permitted to be moved between parents with joint parental rights and responsibilities only if parents have an existing parenting plan in place which is registered with the family advocate and or court order. Further the directions require that the utmost care and caution is taken when moving a child between parents to ensure that the child remains safe and healthy. However, everything must be done in the best interests of the children.

RASHIKA GREE RAJ ATTORNEYS ADVISES THE PUBLIC ON THEIR RIGHTS AND RESPONSIBILITIES As our country stand united and struggle through this pandemic that forcefully gripped our Nation.
From the start of the Nationwide lockdown, our offices have been inundated with telephone calls regarding concerns with regards to their obligations in attending to their financial and personal situations as well as the procedures in order to access government funding.
Our offices therefore enlightens the Nation of South Africa about these concerns that have been dampening their spirits.

LANDLORDS AND TENANTS OBLIGATIONS
There is lot of confusion in the rental property market with regards to the tenant’s obligations and the Landlords rights during the national lockdown. Both the tenants and landlords have equal rights and should act in good faith.

Tenants cannot be evicted if rentals are not paid during the Covid -19 lockdown. This applies to business and residential property. Should the tenants encounter difficulty in paying their rent, they should communicate this would their landlord. The landlord’s duty is to find an alternate remedy that will be beneficial to the both parties.

Our advice would be to speak to the landlord regarding a discounted amount alternatively a payment plan or a payment holiday.

Tenants should keep in mind that regardless of whether you pay rent on time or not, you will in future be responsible for the outstanding rentals which will have an adverse effect on your credit score.
There are many tenants who will use the Covid - 19 pandemic as an escape to genuinely not pay rentals whilst they are in comfort of receiving payment from their employers and or funding that has been set aside for them. We advise that this type of behaviour is unethical and wrong.

Landlords whose tenants cannot pay rentals should request proof that there is no income being received and OR if they have not been trading.
