The rights of inheritance of children born out of the wedlock.

Undoubtedly, for centuries children born of wedlock have been subjected to many discriminations under customary law of succession. One such example is whereby a child born out of wedlock was prohibited from inheriting from or through its father. Certainly, this discrimination had adverse effects on such children’s rights to equality, non-discrimination and dignity. However, in the new constitutional dispensation in South Africa children born out of wedlock are equal to, and worthy of the same respect and consideration as those born in wedlock.

The violation of rights of inheritance of children born out of the wedlock is a violation of Human Rights. Section 9 of the Constitution provides everyone for the right to equal protection and benefits of the law, and South Africa has obligations in terms of the African Charter on the Rights and Welfare of the Child Article 3 of the Children’s chapter the right to non-discrimination.

Any conduct to the contrary is not in accordance with the purpose and spirit of the Administration of Estates Act, the Intestate Succession Act, Reform of Customary Law of Succession and Regulations of Related Matters Act and the Supreme Law of the Republic, and that conduct is invalid.

Welcome to everyone to Sibusiso Mbutho the managing director of SBM and Associates Inc.

Sibusiso holds a Master of Laws degree in Labour Law Studies. He was admitted as the attorney of the High Court of South Africa in the year 2016.

In the year 2015, he was appointed to the Constitutional Court of South Africa as a Law Researcher in the Office of the Chief Justice by Justice Zondo (the Deputy Chief Justice and Chairperson into State Capture Commission of Inquiry.

In the 2015 Sibusiso was selected as an LLM Runner Up in the Ismail Mahomed Law Reform essay Competition which is now known as the South African Law Reform Commission Legal Essay Competition honouring the legacy of the late Chief Justice Pius Langa.
