Improvement liens

The right of ownership is absolute and many rely on this right when suing for ejectment (eviction). However, in the case of an occupier who has made improvements to the owners property, such occupier may have a right of retention to secure compensation for his improvements.

In other words the occupier may not be evicted until his claim has been properly dealt with.

Administration Orders

If you are experiencing financial distress be weary of quick solutions such as an administration order, which may grant a short term reprieve, but impose long term consequences such as not having access to credit facilities and benefits, or having a fixed amount of money being removed from your monthly salary indefinitely, for the benefit of your creditors, regardless of any change in your financial circumstances.

In the matter before court we applied for the rescission (cancellation) of an administration order against client, thereby releasing him from the clutches of administration that had burdened him for some 10 years.

Cohabitation

There have been a number of issues to date regarding couples who cohabitate, yet when the partnership has broken down they want their share of the assets that they had contributed during the partnership. There is no common-law marriage in South African law and therefore the period of time that a couple spends living together does not translate into a default marriage.

The principle of a universal partnership assists cohabitees by affording them a right to a share in the property acquired during the relationship. However, it is always safer to have everything on paper just so there is proof if such breakdown were to happen.

Avoid unnecessary brushes with the law. Call the authorities when you suspect a crime has been committed. Apprehending the suspect on your own may lead to contra allegations and charges being preferred against you. The trauma, emotional strain, and costs are not worth your while.
