Was good to be back in the High Court today, great to be successful and bring it home for my client. Litigation always comes at a cost, especially time and money, but today we managed to block the cynical intentions of a defaulter from abusing the system. What could have been a four year battle was over in six months. What a pleasure!!

A Biological Father's Rights

Recently I was involved in a matter where a biological father sought to enforce his rights of contact and care towards his minor daughter. He had never met her and no bond had previously been established between them.

Unfortunately the child's mother had passed away with no Will and therefore no one had been appointed as the child's legal guardian, although the child remained in the care of her stap father.

As with all matters relating to minor children, the question as to with whom the child must reside will be determined by applying the best interests test.

A step father will not attain superior rights to a biological father if the biological father has been involved in the child's life from day one and if he already has parental rights and responsibilities.

A step father will have rights if he has taken steps to adopt a child legally or if a parent with rights assigns rights in writing to him.

A biological father who has not acquired rights can do so by:

1. Establishing paternity; and,
2. Acquiring rights from the parent with rights; and, or
3. Applying to the High Court or Children's Court.

Ultimately the goal is to reach a working plan that will ensure that the right people are involved in the child's life and development.

Where parties are unable to work things out between them, the dispute will then be determined by the courts jointly with the office of the family advocate.

After a lengthy dispute which ultimately resulted in my client gaining full parental rights and responsibilities, his daughter is now in the best care of a loving father.

When handled correctly, we can make sure that our little ones are protected and given the platform they need so that they can grow into productive members of our society.

You and your Dealer. Know your rights in terms of the Consumer Protection Act.

If you have purchased a second hand car from any dealer that operates the business of car dealership (even wheelers and dealers), then you are guaranteed an automatic six months warranty for any defects in the vehicle.

You need to be able to distinguish between defects and ordinary wear and tear.

I have helped numerous clients with their disputes with dealerships that have not followed through on their promise to supply a working vehicle.

Some housekeeping for 2021:

1. If you are making some stack now and you haven’t concluded or updated your Will... or if you just haven’t done your Will yet, get it done. The Will is free; taxes are not. Don’t be lazy. We live in uncertain times.

Speaking of taxes. If you are like me and need your hand held to ensure a smooth navigation of the tax laws of our land, then consider talking to Natalie Shama, don’t talk to me.. or you can, but I'll just refer you to Natalie.

2. If you are living with your life partner and don’t intend getting married, why not conclude a partnership agreement so that you and your partner are protected and you can at least provide for each other when something unforeseen occurs; like if he forgets to nominate you as the beneficiary of his life insurance and his parachute doesn’t open... a written agreement from him promising you a share of his estate would go a long way.

3. If you were going to get married in 2020 and have postponed to 2021, or if your proposal is imminent and you get that "yes!", make sure you get good advice and don’t make the mistake of not signing a marriage contract.

If you did make that mistake and have found yourself married in community of property, well you're probably screwed. Maybe not! Depending on your circumstances it is possible to register a marriage contract post wedding day.

4. If you have invented something cool, make sure you get good advice on how to protect your IP.

5. If you're tired of sleeping in the dog box and you can’t get through to your spouse, consider inviting your spouse to mediation, rather than outright war.

6. Business Owners Alert! If you have a contractor who is not performing or has performed terribly and you want to get rid of them. Don’t just hire someone else without properly terminating the first contractor's agreement or you may end up with two contractors and on the back foot even further.
