'Hippo' with its latest Insurance comparison add wherein a hippo urges the customer to select the best insurance offer, is stirring up a storm. In the add, the customer instructs the insurance salesman to get out of the vehicle. Outsurance is now alleging that this add infringes on their Trade Mark and deflates its reputation. Do you agree?

The word BOEREWORS cannot serve as a trade mark for sausages, as it will not distinguish sausages manufactured by one trader from that of another. It will thus not serve the purpose of a trade mark. The word is reasonably required for use by other traders in the same market. Should we register the mark, the owner of the registration would acquire the exclusive right to use this word and thereby prevent all other traders from using it. This cannot be allowed. Therefore, the aim would be to come up with Trade Marks which are invented words, logos or pictures since they are generally distinctive and provide good options for registrable Trade Marks.
