SARS recently implemented a significant change affecting property transactions nationwide. As of 8 December 2025, both the seller and the purchaser are now required to be registered for tax if the value of a transaction exceeds R2 million.

Tax registration was not always mandatory for the transaction to proceed. However, under the new regulations, SARS will not issue a Transfer Duty Receipt unless both parties have a valid tax number. This is a critical requirement for the Deeds Office registration process.

Failing to ensure that both parties are tax-compliant before initiating a sale can lead to major delays in the registration of the transaction, adding unnecessary stress to what should be an exciting milestone.
