Some useful tips when you buy a house/stand:

1. Remember that a verbal agreement is unenforceable and that it is mandatory to enter into a written agreement of sale (Offer to Purchase).
2. Keep in mind that if you need to apply for a loan (mortgage bond) there would be additional costs to register the bond as well as transfer costs. The purchaser will be liable for the above-metioned costs.
3. When selling your property the seller will be liable for the existing bond cancellation costs as the bond needs not only to be paid up but also cancelled.
4. The whole process can take a month or more to compile and prepare all documents and the registration process in the relevant Deeds Registries office takes at least 10 working days.
5. If you purchase property from a deceased estate it may take remarkably longer.

On Friday 11 December 2020 the Western Cape High Court ruled that the cigarette ban instituted during the country's Covid-19 lockdown was unconstitutional.
The judgment stated that BATSA's loss of revenue suffered within the first 9 weeks of lockdown alone, exceeded R2 million.
More losses were expected for as long as the ban continued.

Getting married is one of the most exciting times in your life. An Antenuptial Contract is often left to the last minute or even overlooked. Here are reasons why an antenuptial contract in marriage should be considered:

- If the spouses do not enter into an Antenuptial Contract prior to marriage, it means that they will get married in community of property. In essence this means that everything owned by the two spouses will be pooled in one estate and will be jointly owned in equal shares by both spouses. Spouses entered into a customary marriage is also considered to be married in community of property.

- An Antenuptial Contract is a contract entered into prior to marriage and sets out the terms and conditions which will govern the dissolution of the marriage (whether divorce or death) and it also provides for the exclusion of community of property between the spouses.

- An Antenuptial Contract may include any terms and conditions as long as they are not illegal, immoral or contrary to public policy. Most terms and conditions relate to the division of assets should the marriage dissolve due to death or divorce.

- When entering into an Antenuptial Contract you will not be held liable for any debt that your spouse might have incurred prior to the marriage or any liability during the marriage.

- Certain assets have sentimental or financial worth you do not want to become part of the estate.

- You will be able to enter into transactions with regards to your own assets, without obtaining consent of your spouse each time.

- You will retain your individual financial identity independently from that of your spouse.

- You do not risk losing your combined assets if one undertakes a business venture.

- If judgment is obtained against your spouse, your assets cannot be judicially attached.

You can enter into a contract after marriage by means of a Postnuptial Contract. This process is expensive and complicated and is advisable to consult a lawyer and conclude an Antenuptial Contract before you are married.
