This is one of the most misunderstood areas in family law. Your child turning 18 does not automatically end maintenance obligations.

In South Africa, a parentโ€™s duty to support a child can continue for as long as the child remains financially dependent.

This may include situations where a child is:

โ€“ Still studying
โ€“ Unable to support themselves financially

That means maintenance can continue well into early adulthood.

Stopping maintenance without formally varying an existing arrangement or court order can have legal consequences. While support arrangements can change as circumstances change, it is important to follow the proper legal process.

The Bill of Rights, contained in Chapter 2 of the Constitution, protects the fundamental rights of everyone in South Africa ๐Ÿ‡ฟ๐Ÿ‡ฆ

These rights shape how people are treated, how decisions are made, and how justice is applied every day.

Rights like equality, dignity, and access to courts are there to protect you in real situations.

If youโ€™re unsure where you stand, itโ€™s worth getting clarity.

You asked, we answered:

These are some of the questions our family law team has heard most in practice.

Having the right information can make a real difference when youโ€™re planning and making decisions for your child.

In many cases, income during this time comes from UIF, not your salary. Payment from your employer is not automatic unless your contract says otherwise.

Check your contract and apply for UIF early to avoid gaps in income.

Not always. It depends on factors like the parentsโ€™ relationship and the fatherโ€™s role in the childโ€™s life.

Itโ€™s best to get advice early.

You can name your preferred guardian in your will and courts take this seriously, but they will always decide based on whatโ€™s best for your child.

Save this, share it, or send it to someone who needs it ๐Ÿค

โœง Meet Anyuschka Nett โœง

Over the years, Anyuschka has built a strong reputation for how she works with her clients. Sheโ€™s known for being thorough and for getting things right, especially in areas where small details can have big consequences.

We asked her a few questions so you can get to know her a bit better:

โŸน What do you enjoy most about what you do?

โ€œI enjoy being part of a general practice where we can help clients from start to finish, without sending them somewhere else halfway through. Every client is different, so I focus on clear communication and on being available when questions come up.

My litigation background also helps. Iโ€™ve seen where things go wrong, so I can often spot an issue early and deal with it before it becomes a bigger problem.โ€

โŸน One moment in your career that stood out

โ€œA client came to me for what looked like a straightforward property transfer. In our first meeting, a few details stood out to me. There were clauses in a related agreement that Iโ€™ve seen lead to disputes before.

Instead of just processing the transfer, we took a step back, reworked the commercial terms, and addressed the risk up front. Everything was handled in one place, with one point of contact.

What stuck with me was the client saying, โ€˜I didnโ€™t expect the legal side to be this clear or this easy.'โ€

โŸน One piece of advice youโ€™d give people

โ€œGet your attorney involved early, not when youโ€™re already about to sign. Itโ€™s much easier (and cheaper) to prevent a problem than to fix one later.

Work with someone who takes the time to explain things properly and is actually available when you need them. Legal matters donโ€™t happen in isolation, and your legal support shouldnโ€™t either.โ€

Today is Freedom Day, a defining moment in South African history.

It is a time to acknowledge the people, the voices, and the long road that shaped the Constitution we rely on today, built on dignity, equality, and freedom.

These principles guide the Courts and everyday life, from family and property to business and the delivery of justice.

At Luitingh & Associates, we proudly help people navigate this framework with clarity, care, and confidence.

Hereโ€™s to a unified, inclusive democracy ๐Ÿ‡ฟ๐Ÿ‡ฆ

Property transfer delays are often seen as unavoidable.

In practice, they are usually caused by a combination of smaller factors rather than a single major issue.

Common causes include:
โ€” Municipal rates clearance delays
โ€” Bond approval or registration delays
โ€” Incorrect or incomplete documentation
โ€” Outstanding compliance requirements

Timing also plays a role. Delays often start earlier in the process than people expect, particularly when requirements are addressed too late.

With the right preparation early on, some of these delays can be reduced or even avoided completely.

If youโ€™re navigating a property transfer, feel free to reach out or send us a message.

UPDATE | An incredible achievement worth celebrating ๐Ÿ‘

We would like to extend a heartfelt congratulations to our client, Steve Murphy, on completing the Bay to Bay Walk, covering over 300 km in just 14 days.

Steve set out with an ambitious goal to raise funds for education, and this has grown into something even more meaningful:

โ€ขโ  โ Over R250,000 raised through public support
โ€ขโ  โ A further R1 million in educational bursary funding pledged by the Graduate Institute of Financial Sciences (GIFS)

This is a powerful reminder of what can happen when determination meets community support.

We are honoured to have supported this initiative in a small way as a trusted facilitator behind the scenes.

Well done to everyone involved!
