Can your employer ask for a medical certificate before paying sick leave?

The BCEA allows an employer to require a medical certificate if an employee is:

โ€ข Absent for more than two consecutive days, or
โ€ข Absent on more than two occasions during an eight-week period.

It is also important to check your employment contract and workplace policies, as these may contain additional requirements.

This is one of the most misunderstood areas in family law. Your child turning 18 does not automatically end maintenance obligations.

In South Africa, a parentโ€™s duty to support a child can continue for as long as the child remains financially dependent.

This may include situations where a child is:

โ€“ Still studying
โ€“ Unable to support themselves financially

That means maintenance can continue well into early adulthood.

Stopping maintenance without formally varying an existing arrangement or court order can have legal consequences. While support arrangements can change as circumstances change, it is important to follow the proper legal process.

โŸน What do you enjoy most about what you do?

โ€œI enjoy being part of a general practice where we can help clients from start to finish, without sending them somewhere else halfway through. Every client is different, so I focus on clear communication and on being available when questions come up.

My litigation background also helps. Iโ€™ve seen where things go wrong, so I can often spot an issue early and deal with it before it becomes a bigger problem.โ€

โŸน One moment in your career that stood out

โ€œA client came to me for what looked like a straightforward property transfer. In our first meeting, a few details stood out to me. There were clauses in a related agreement that Iโ€™ve seen lead to disputes before.

Instead of just processing the transfer, we took a step back, reworked the commercial terms, and addressed the risk up front. Everything was handled in one place, with one point of contact.

What stuck with me was the client saying, โ€˜I didnโ€™t expect the legal side to be this clear or this easy.'โ€

โŸน One piece of advice youโ€™d give people

โ€œGet your attorney involved early, not when youโ€™re already about to sign. Itโ€™s much easier (and cheaper) to prevent a problem than to fix one later.

Work with someone who takes the time to explain things properly and is actually available when you need them. Legal matters donโ€™t happen in isolation, and your legal support shouldnโ€™t either.โ€
