This is one of the most misunderstood areas in family law. Your child turning 18 does not automatically end maintenance obligations.

In South Africa, a parent’s duty to support a child can continue for as long as the child remains financially dependent.

This may include situations where a child is:

– Still studying
– Unable to support themselves financially

That means maintenance can continue well into early adulthood.

Stopping maintenance without formally varying an existing arrangement or court order can have legal consequences. While support arrangements can change as circumstances change, it is important to follow the proper legal process.

Having the right information can make a real difference when you’re planning and making decisions for your child.

✢ “𝐖𝐢𝐥𝐥 𝐈 𝐛𝐞 𝐩𝐚𝐢𝐝 𝐝𝐮𝐫𝐢𝐧𝐠 𝐦𝐚𝐭𝐞𝐫𝐧𝐢𝐭𝐲 𝐥𝐞𝐚𝐯𝐞?”

In many cases, income during this time comes from UIF, not your salary. Payment from your employer is not automatic unless your contract says otherwise.

Check your contract and apply for UIF early to avoid gaps in income.

Over the years, Anyuschka has built a strong reputation for how she works with her clients. She’s known for being thorough and for getting things right, especially in areas where small details can have big consequences.

⟹ What do you enjoy most about what you do?

“I enjoy being part of a general practice where we can help clients from start to finish, without sending them somewhere else halfway through. Every client is different, so I focus on clear communication and on being available when questions come up.

My litigation background also helps. I’ve seen where things go wrong, so I can often spot an issue early and deal with it before it becomes a bigger problem.”

⟹ One moment in your career that stood out

“A client came to me for what looked like a straightforward property transfer. In our first meeting, a few details stood out to me. There were clauses in a related agreement that I’ve seen lead to disputes before.

Instead of just processing the transfer, we took a step back, reworked the commercial terms, and addressed the risk up front. Everything was handled in one place, with one point of contact.

What stuck with me was the client saying, ‘I didn’t expect the legal side to be this clear or this easy.'”

⟹ One piece of advice you’d give people

“Get your attorney involved early, not when you’re already about to sign. It’s much easier (and cheaper) to prevent a problem than to fix one later.

Work with someone who takes the time to explain things properly and is actually available when you need them. Legal matters don’t happen in isolation, and your legal support shouldn’t either.”

Property transfer delays are often seen as unavoidable.

In practice, they are usually caused by a combination of smaller factors rather than a single major issue.

Common causes include:
— Municipal rates clearance delays
— Bond approval or registration delays
— Incorrect or incomplete documentation
— Outstanding compliance requirements

Timing also plays a role. Delays often start earlier in the process than people expect, particularly when requirements are addressed too late.

With the right preparation early on, some of these delays can be reduced or even avoided completely.

UPDATE | An incredible achievement worth celebrating 👏

We would like to extend a heartfelt congratulations to our client, Steve Murphy, on completing the Bay to Bay Walk, covering over 300 km in just 14 days.

Steve set out with an ambitious goal to raise funds for education, and this has grown into something even more meaningful:

•⁠ ⁠Over R250,000 raised through public support
•⁠ ⁠A further R1 million in educational bursary funding pledged by the Graduate Institute of Financial Sciences (GIFS)

This is a powerful reminder of what can happen when determination meets community support.
