When Can a CCMA Commissioner Correct an Earlier Jurisdictional Ruling?

A CCMA Commissioner must determine the true nature of a dispute before deciding jurisdiction. An earlier jurisdictional ruling may be corrected where it was based on an incorrect understanding and did not finally determine the merits.

When is a restraint of trade reasonable?

A recent Labour Court judgment highlights why restraint clauses must be carefully tailored to the employer’s legitimate interests. A geographically broad restriction, speculative concerns and the rejection of meaningful employee undertakings may undermine an employer’s attempt to enforce a restraint.

The Court declined to enforce the sweeping non-competition clause but converted the employee’s narrower undertakings into an enforceable court order.
