New Earnings Threshold Effective 1 May 2026

The Minister of Employment and Labour has published a new earnings threshold under the Basic Conditions of Employment Act.

From 1 May 2026, the threshold increases to R269,600.90 per annum.

So what does this mean in practice?

Employees earning above this threshold are excluded from certain provisions of the BCEA, including aspects of:

- Working hours
- Overtime
- Meal intervals
- Rest periods

This makes it critical for employers to:

✔ Review employment contracts

✔ Reassess working time arrangements

✔ Ensure compliance frameworks are up to date

A quick but important reminder: “earnings” refers to annual remuneration before deductions, excluding certain allowances and overtime payments.

If you’re unsure how this change impacts your business or workforce, now is the time to get clarity before implementation.
