Mid-year legal housekeeping: before August arrives with opinions..

July is done! But, before the second half of the year gets away from you, take a moment to check the documents and decisions that quietly carry your business.

Your mid-year legal checklist:

✔️ Contracts still aligned with how the business operates?
✔️ Shareholder agreements still fit for purpose?
✔️ POPIA and PAIA documents up to date?
✔️ Wills, trusts and executor appointments reviewed?
✔️ Property agreements and leases current?
✔️ Dispute-resolution clauses doing more than decorating the contract?

Legal housekeeping is rarely glamorous.
But neither is explaining later why nobody checked.

AI in law: useful, fast - and occasionally overconfident

AI has entered the legal world with pace.
- It drafts.
- It summarises.
- It researches.
- It reviews.

And sometimes, it makes things up with astonishing confidence.

That does not make AI useless. Far from it.
It makes oversight essential.

The real issue is not whether legal and business professionals should use AI. They already are.

The issue is how they use it responsibly.

Before relying on AI-generated content, businesses should ask:
▪️ Who checked the output?
▪️ What data was used?
▪️ Does POPIA apply?
▪️ Is confidential information being exposed?
▪️ Who remains accountable if the advice is wrong?

Technology changes quickly.
Responsibility does not.

The issue is no longer whether businesses and law firms should use AI. They already are. The real question is whether they are using it with enough discipline, oversight and legal common sense.

Mandela Day reminds us that progress often begins with dialogue.

In law, as in life, not every disagreement needs to become a battle.
Mediation can help parties find practical, respectful and lasting solutions.

AI is a powerful tool. But it isn't your legal advisor.

Artificial intelligence can help businesses draft documents, summarise information and speed up everyday tasks. But it can't replace judgment, experience or accountability.
Before relying on AI-generated contracts, policies or legal advice, ask yourself:
✔️ Has someone reviewed it?
✔️ Is confidential information protected?
✔️ Who is accountable if it's wrong?

As PJ Veldhuizen writes in our latest opinion piece:
"AI should be treated as digital staff, not digital counsel. Helpful, fast and occasionally brilliant, but still in need of supervision."

Property transfers: what can possibly go wrong?
Quite a lot, actually.

Conveyancing is often seen as paperwork - until a missing document, an unfulfilled suspensive condition, an unresolved bond issue or a compliance certificate delay turns the transaction into a problem.

Before signing an Offer to Purchase, ask:
▪️ Are all suspensive conditions clearly recorded?
▪️ Are compliance certificates understood and allocated?
▪️ Are timelines realistic?
▪️ Are the parties signing what they think they are signing?
▪️ Has the structure of ownership been properly considered?

Property transfers do not reward assumptions.
They reward preparation.

It is with great sadness that we share the passing of our colleague and friend, Denzil Jehoma who tragically passed away on Wednesday.

Denzil was part of the Gillan & Veldhuizen family for many years, serving as our trusted legal messenger long before many of us joined the firm. His reliability, kindness and unwavering commitment meant he was a familiar face not only to our team, but also to our clients, the courts and the many professionals he encountered each day.

Behind every successful law firm are people whose contributions often happen quietly, behind the scenes. Denzil was one of those people. He carried out his role with humility, dedication and pride, leaving a lasting impression on everyone who had the privilege of knowing him.

Today, we remember him not only for the work he did, but for the person he was.
Our heartfelt condolences go to Denzil's family, friends and loved ones during this incredibly difficult time.

May he rest in peace.

AI is changing the legal and business world.

It can draft, summarise, analyse and automate tasks faster than ever before.

But there is one thing AI still cannot do: Exercise judgment.
The responsibility for decisions, advice and outcomes still rests with people.

In his latest article, PJ Veldhuizen explores the opportunities, risks and realities of AI in modern legal practice.

If it's worth buying, it's worth documenting.

Property transactions involve significant investments, which is why written agreements matter.

Verbal understandings can lead to misunderstandings, disputes and costly consequences down the line. A properly drafted agreement creates clarity, certainty and protection for everyone involved.

As PJ Veldhuizen puts it:
"A verbal agreement is only perfect until someone remembers it differently."
