Nelson Chamisa deliberately ignored the constitutional proceedings of disputing elections and embraced the election results by not taking any of the constitutional procedures which makes it a criminal offense to incite or promote public disorder, public violence and endangering public safety, adversely affecting our national sovereignty and economic stability over an undisputed election. No demonstration against the 2023 elections will ever be legal and I warn our citizens to avoid engaging or be found amongst those planning to demonstrate on the 7th of August against the 44th SADC Summit in Zimbabwe. The state security forces will always be there to protect the law and take responsibility of bringing traitors to justice.

Section 93 of the Zimbabwean Constitution deals with the ‘challenge to presidential election’. It clearly elucidates the provisions regarding the manner in which Presidential elections must be challenged,processed and prosecuted which Mr Chamisa ignored. Our citizens must know that, A presidential election challenge is initiated by “lodging a petitionor application with the Constitutional Court within seven days after the date of the declarationof the results of the election”. This is the only way an election can be disputed in Zimbabwe not some social media hallucinations being pedled by Chamisa's misinformed surrogates.

Once a challenge is lodged the Constitutional Court of Zimbabwe must dispose of it within14 days after the petition or application was lodged, and the Court’s decision is final’. Ondetermining the challenge, the CCZ is empowered to make an order from a wide range. Section 93(4) empowers it to declare a winner, nullify the election and trigger a fresh electionwithin 60 days, or “make any other order it considers just and appropriate”.

The pleadings must be governed by Rule 23 of the CCZ Rules. In essence, therefore,section 93 of the Constitution must be read together with the relevant CCZ Rules to get a fullpicture of the principles and procedure to be followed in dealing with a presidential petition.

Please citizens of Zimbabwe don't risk your freedom, engaging in these illegal demonstrations being planned whether in South Africa or Zimbabwe. You will definitely be arrested and face justice.

In a landmark decision, the Constitutional Court yesterday, 18 June 2024, confirmed that Zimbabwean Exemption Permit (ZEP) holders have a right to fair administrative action, and officially dismissed Home Affairs Minister Aaron Motsoaledi’s attempt to appeal the 2023 High Court judgment that found in their favour.

This ruling comes after the Helen Suzman Foundation in collaboration with a Capetown based Zimbabwean prominent lawyer Advocate Talent Rusere and the Consortium for Refugees and Migrants in South Africa (Cormsa) challenged the Minister of Home Affairs’ decision to terminate the ZEP under the Promotion of Administrative Justice Act, 2000 (PAJA).

The challenge was initiated on the grounds that the Minister’s decision was unlawful, invalid, and unconstitutional, impacting approximately 178,000 Zimbabwean nationals currently holding ZEPs.

On June 28, 2023, the Pretoria High Court ruled in favour of the applicants, finding that the decision was procedurally unfair and infringed on the constitutional rights of ZEP holders. The court highlighted that the Minister’s failure to conduct a fair ‘notice and comment’ process rendered the decision uninformed and procedurally irrational.

The High Court’s decision was set aside and remitted back to the Minister to conduct a fair process that considers the views and interests of ZEP holders and the broader society.

Despite the Minister’s attempts to appeal the High Court’s decision, including applications to the High Court and the Supreme Court of Appeal, the Constitutional Court dismissed the Minister’s application for special leave to appeal on 18 June 2024.

The Constitutional Court found that the application had no reasonable prospects of success. Norton Rose Fulbright South Africa’s Impact Litigation directors Jason Whyte and Laura Macfarlane, under the firm’s social impact team, represented Cormsa in the matter, with Advocate David Simonsz providing assistance. Their combined efforts were instrumental in securing this significant ruling that upholds the rights of ZEP holders.

*What happens next?*
The Minister of Home Affairs is now required to comply with the High Court’s order. Any future decisions regarding the ZEP must be made in a fair and just manner, ensuring that the views and interests of ZEP holders are adequately considered. The ZEP will remain effective until 29 November 2025.

The role of opposition parties is critical in determining the level of accountability by governing parties and governments, the effectiveness of public service delivery and the overall quality of a country’s democracy.

Opposition parties provide alternative visions, policies, and leaders to the governing party. They scrutinise government decisions, policies, and actions – and play oversight over the Executive and the public administration. They defend the voters’ interests – not only their constituencies but all the country’s voters.

Opposition parties’ ability to show the electorate they are credible alternative governments is crucial to the credibility of the democratic system. A democratic system is significantly undermined if the opposition does not offer any credible alternatives to the governing party, is invisible in the public debate or does not have a public profile beyond during elections.

Without clear alternatives offered by opposition parties, a country cannot have constructive debates on policy options, the direction of the country and the future. In fact, the strength, effectiveness, and quality of a democracy largely depend on the opposition parties’ efficiency, relevance, and ability to credibly show they are ready to govern. This is the media statement released tonight by Zimbabwe’s election commission, ZEC!

They have literally said, "Leave us alone, we know nothing about it."

It leaves no complainant except for Mike Chimombe and Mpofu, who released voice notes alleging that Wicknell Chivhayo didn’t pay them from the proceeds of the ZEC deal.

Chimombe and Mpofu are said to be out of the country in China.
Meanwhile, insiders in Government are saying the police want to interview them about two other deals involving millions looted from a goat project, and money looted from Harare City Council, going back to 2016.

Zimbabwe’s anti-corruption commission, ZACC, issued a statement saying that they want to interview Chivhayo, Chimombe and Mpofu on the ZEC deal.
Sources say Chivhayo was interviewed this week, and ZACC is now waiting for Chimombe and Mpofu.
It is going to be a long weekend for all involved!

We stand at a critical juncture in our nation's history. Our natural resources, the very foundation of our country's wealth and prosperity, are being plundered by those in power. It is our collective responsibility to act and ensure that our minerals are protected for future generations.

The looting of our resources is a stark reminder of the importance of unity in the face of adversity. We cannot afford to let political differences divide us while our country's wealth is being exploited. We must put aside our differences and come together to demand accountability and transparency in the management of our natural resources.

By uniting, we can:

- Demand stronger regulations and oversight to prevent corruption and environmental degradation
- Advocate for fair distribution of resource revenues to benefit all citizens, not just a privileged few

Political engagement must build a mutual beneficial relationship between the ordinary citizens, civic organizations,relevant elected representatives, including state and federal members of parliament, ministers, local councillors and mayors not privileged politicians or foreign funded political entrepreneurs or individuals.

Political engagement is not a partisan or individual activity. The relationship between our people and elected representatives should be based on the guiding principles of socialism, not political affiliations of particular individuals.

A successful, political engagement must strengthen the connection between the electorate and the elected leadership not political elites. We must stop politics of hate and insubordination. Only then we can reconstruct and develop a sustainable economy as a Nation.

A disillusioned group of South African based Nelson Chamisa supporters are planning to Assassinate Zimbabwe's youngest opposition leader and Lawyer Professor Talent Rusere. This comes after the young intellect refused to join forces with a Nelson Chamisa CCC faction inciting violence through social media platforms, calling out for an illegal Boarder Shutdown towards the 2024 August SADC Summit to be held in Zimbabwe.

Before turning his back to Western funded opposition politics in Zimbabwe,Rusere who once served as Mugabe's central intelligence agent has been vociferously instrumental in Zimbabwe's opposition politics since 2019. He founded the most influential , and other successful demonstrations Zimbabweans ever staged at both local and international level.

According to the video published by 'The African Vew' Rusere said, "I do not subscribe to politics of hate. If it once happened that was before and not now! Politics must be for policy building, economic sustainability and national development nothing else more. I believe in national unity not this nonsense of peddling the Western Policy on the expanse of our National Soveirnity and a black child's economic freedom.

I will take a stand against any form of National misrepresentation whenever it's necessary. Our Politics must protect national interests and build our communities. Zimbabwe has been waiting for this kind of opposition engagement for the past 24 years and I believe,this is the right time to do what's right".
