Melanie Coetzee - Compliance Consultant

Melanie Coetzee - Compliance Consultant * F**A, Data Privacy, GDPR, Business Compliance specialist and legal consultant * She was head girl in both primary and high school.

Having completed the BPROC and LLB degrees at the old UPE in Port Elizabeth in 1999, Melanie ventured abroad and worked at a law firm, OM Mark & Associates in Mayfair London. After returning to South Africa and qualifying as an Attorney, Notary and Conveyancer all in one year, Melanie decided to spread her wings and moved to Cape Town to work at one of the largest conveyancing law firms in South A

frica – first at the Hout Bay office, then in the Cape Town office and finally in the Table View office as the manager. A breast cancer diagnosis in 2018 changed the direction of the ship on which Melanie sails and the destination of her anchors! She has said farewell to corporate and braved the start of her LEGAL AND COMPLIANCE business in October 2020. Melanie has always been a passionate conveyancing attorney and has always incorporated training as part of her marketing from very early on. Melanie’s training ability stems from being an avid public speaker at school and always having held leadership positions throughout her life. From a practice perspective, Legal Compliance has always interested Melanie and as a result, she was instrumental in launching her previous firm’s F**AA Risk Based documentation to the satisfaction of FIC and people from all different levels within the firm would refer enquiries to Melanie for determination. In the Covid 19 era, Melanie was appointed as the firm’s Covid Compliance Officer, drafted and implemented the Covid Policy documents and procedures within such a large organisation with good success and generally implemented the rules applicable to the various offices within the firm. Melanie has also assisted many estate agencies and other businesses with their internal F**AA Manuals as well as Covid Protocols. With so many changes to the laws and rules applicable to the property industry, Melanie has been training agents in respect of the Protection of Personal Information Act (“POPIA”) as well as the Promotion of Access to Information Act (“PAIA”) as well as the European Privacy GDPR Regulations. In addition, Melanie is a specialist in the myriad of rules which apply when foreigners invest funds into property here in South Africa and has worked for years with the Reserve Bank’s exchange control department as well as with the Receiver of Revenue and the banks in respect of these clients and she is often told by clients how valuable it is for foreign investors, especially those who reside in South Africa temporarily to be able to turn to someone able to advise on all aspects related. This has often avoided dire consequences which may have arisen in the future. Melanie joined Bax Kaplan Russell Atorneys as Consultant in April 2021 and operates from their Colloseum, Century City offices in Cape Town where she attends to the registration of property transfers with the support of the other atrorneys and paralegals there. Melanie’s passion for conveyancing, training, compliance, consultation, drafting and foreign investors shines brightly through her interactions and she is excited to be able to focus on these areas in particular.

Have you heard of the R7,7mill fine issued to a prominent law firm by FIC on Friday, 13 September 2024?

Why are these fines being issued so aggressively? Because law firms, estate agencies, accountancies and sales businesses who sell goods worth more than R100k use "copy and paste" Policies and find poor guidance on which to rely. Which leads to poor results during the Inspections. People simply do not really understand the F**A requirements properly.

Why not join us for an insightful seminar this coming Friday, 20 September 2024 at the Theatre on the Bay! There are still a few seats available.

If you are in Cape Town and wish to come along, please rsvp to Tani: [email protected].

NEW COLD CALLING RULES

All businesses, but in particularly real estate businesses need to address their Direct Marketing rules and processes in order to comply with the February 2024 Sanction Notice issued by the Information Regulator.

A Direct Marketing Policy is needed to create the parameters for cold calling and how to deal with client contact lists

ATTENTION: PROPERTY PRACTITIONERS

On 22 March 2024, some or all of you would have received an email from the PPRA (EAAB) in which you were instructed to each individually submit the F**A Directive 6 Risk & Compliance Return.

This Notice is incorrect:

- The Directive 6 RCR cannot be submitted by individual estate agents;

- The Directive 6 RCR is to be submitted by registered Estate Agencies who have FIC ORG NUMBERS as well as branches of these Estate Agencies which are independently registered with ORG NUMBERS.

Please do not react to the incorrect PPRA Notice as we are certain that, as with the legal profession’s LPC about 10 days ago, the incorrect PPRA Notice will be corrected. Agents should read Agencies.

Please be in touch with our office if you still have not updated your 2023 RMCP Policy or if you need F**A help otherwise -

Only 52% of law practices have submitted the Directive 6 RCR and less than 42% of property practitioners have submitted the RCR. These two industries and its unwillingness to become fully F**A compliant may result in SA remaining on the FATF Grey-List.

FIC has until May 2024 to enable these industries' full compliance.

Why wait to become compliant? Do the RIGHT THING and avoid the wrath of FIC in the upcoming months.

Penalties are on the way for delinquent companies that do not report to the Financial Intelligence Centre.

ANOTHER CLIENT OF OURS PASSES THEIR F**A INSPECTION!

With F**A compliance still being underestimated, we are often only approached by law firms and estate agencies once the Inspection Notice is received. With our support, law firms and estate agencies pass their Inspections.

See what our client, a multi-office national law firm, had to say this week after passing a very stressful Inspection. With our support.

Why wait? Knowing that FIC will knock on your door next?

Another client passes the FIC INSPECTION!

We work with our clients for months in order to reach the point where FIC accepts both the RMCP Policy and the risk-based methodology in the client files.

There is NO better feeling for any Accountable Business than when FIC issues the Final Inspection Report (after 3 months of stress and anxiety) as FULLY COMPLIANT!

Take aways here:

* RMCP Policy Templates do not pass FIC's expectations;
* It takes a lot of work to get the due diligence process perfect;
* Most (if not all) law firms, accountancies and estate agencies are still on the non-compliant spectrum;
* Full F**A compliance is still grossly underestimated;
* FIC fines are REAL and sting (badly)....

We are here to help!
