We are excited to announce the names change of Duff Pretorius Attorneys and Notaries to Duff & Associates Attorneys and Notaries, with effect from 1 March 2023.



This name change allows us to retain the best aspects of the previous version of the firms, while moving towards the exciting growth opportunities that are ever present in our beloved (if chaotic) country.



The mission and vision of Andrew Duff (senior partner), ably assisted by his newly admitted associate, Celeste Olckers, and the newly promoted candidate attorney, Hazel Nhlapo, will remain extent throughout the service offering, and you can continue to expect and enjoy the highest quality legal services that the firm provides.

Dear valued clients, colleagues and friends,

After more than a decade with Andrew Duff Attorneys and now Duff Pretorius Attorneys and Notaries, Liza Pretorius will be leaving the firm to pursue a new business venture. Her last day with the firm will be 30 June 2022.
During the month of June, she will be assisting the firm with administrative aspects and handover of certain files on an ad hoc basis.
Please be assured that you can continue to expect the highest level of care and service from the firm during the transition period and there will be no interruption in our service delivery.

POPI Act compliance - Condition for lawful processing of personal information - Security Safeguards
This is the seventh of eight conditions for the lawful processing of personal information which must be complied with by all businesses.
But what does the condition for Security Safeguards stipulate?
The condition for Security Safeguards:
1. Places a duty on businesses to secure the personal information in its possession and under its control.
2. To ensure the security and safeguarding of personal information, businesses must implement organisational and technical measures.
3. This condition also places a duty on businesses to ensure that anyone who processes personal information on their behalf (Operator) has appropriate security measures to safeguard information.
4. Businesses (Responsible Parties) must enter into written contacts with these Operators.
5. In the event of any security compromises, or if such compromise is suspected, the responsible party must notify the Information Regulator and the person to whom the personal information relates (Data Subject).

POPI Act compliance - what is the difference between a responsible party and an operator?
A Responsible Party is a person or entity who determines the purpose or means for processing personal information. It is usually, but not always, the business or company.
An Operator - Processes personal information for or on behalf of a responsible party.
For example: Mr X has a company XYZ Construction. He determines that he requires his employees names, surnames, banking details, etc. for the purpose to pay monthly salaries and he manages his employees information and data on their own internal IT and payroll system. Mr X, specifically XYZ Construction, is a responsible party.
Numbers Accounting is a bookkeeping and accounting service provider. If Mr X appoints Numbers Accounting to render accounting and payroll services to XYZ Construction, instead of managing payroll on his own, and Numbers Accounting then process the employees' personal information on behalf of XYZ Construction, Numbers Accounting will be the Operator.

If you want to get married out of community of property with the inclusion of the accrual system, it is important to know that certain assets belonging to either spouse are automatically excluded and will not be taken into consideration when calculating the accrual, for example:

(i) any inheritances, legacies or gifts that either spouse has received during the marriage;
(ii) donations made by one spouse to the other;
(iii) damages awarded to either spouse for non-patrimonial loss. This is damages or when a spouse is awarded an amount of money for something which relates to the impairment of an interest of your life or well-being such as loss of amenities, loss of a limb and
any damages awarded to either spouse for defamation or for pain and suffering; and
(iv) Assets or interest excluded in terms of the ANC.

Duff Pretorius Attorneys and Notaries is a boutique law firm which was established in 2019. The firm was originally Andrew Duff Attorneys which was founded by our Senior Partner, Andrew Duff in September of 2010. During 2019, Liza Pretorius was promoted to partner and Duff Pretorius Attorneys and Notaries was born.

We are situated in Bryanston, in the heart of Northern Johannesburg, providing easy access from both the city centre, Sandton and its surrounds. Our offices are found in the picturesque La Rocca Office Park, 321 Main Road corner Petunia Street, Bryanston, which location places the firm within the jurisdictions of the Johannesburg High Court, Johannesburg Magistrate’s Court and Randburg Magistrate’s Court respectively.
