Most couples plan the wedding in detail and never think about the one decision that shapes their finances for the whole marriage.

In South Africa, if you marry without an antenuptial contract, the law automatically puts you in community of property. One joint estate, owned equally. The part that catches people out isn't the assets, it's the debt: a creditor of one spouse can claim against the shared estate, including what the other spouse brought into the marriage.

You do have other options, but they only work if you act before the wedding. After it, changing your regime means a costly High Court application.

The reality is that a property transfer involves far more than simply registering a change of ownership. There are contracts, compliance checks, SARS, municipal requirements, transfer documents, bonds and the Deeds Office examination process, all of which need to come together before registration can take place.
