Did you know that old debt can legally expire in South Africa? 💳

It is called a prescription, and it means that if a creditor has not come after you for a debt in 3 years, they may no longer be able to force you to pay it.

This applies if:
✅ No legal action has been taken against you
✅ You have not made any payments towards the debt
✅ You have not admitted to owing the debt in writing

Before you pay an old debt — or even respond to someone claiming you owe money — check whether it has expired first.

Important: This does not apply to all debt. Home loans and court judgments have different rules.

Selling your home? Here is something many sellers do not think about until it is too late. 🏡

When you sell, your home loan does not just disappear. It needs to be officially cancelled — and there are costs and steps involved.

What you need to know:
✅ You need to give your bank 90 days' notice that you are cancelling your bond
✅ If you do not give notice in time, the bank can charge you a penalty
✅ A cancellation attorney (appointed by your bank) handles the process
✅ The cancellation costs come out of your pocket as the seller
✅ Your outstanding bond gets paid off from the sale money first

Getting this wrong can delay your transfer or leave you with unexpected costs.

Thinking of starting a business? One of the first decisions you need to make is how to register it — and it matters more than most people think. 💼

Here is a simple breakdown:

🔹 Sole Proprietor — You and the business are the same thing. Easy to set up, but if the business has debt, you personally owe it.

🔹 Close Corporation (CC) — You cannot register a new CC anymore, but existing ones still operate. Your personal assets are more protected.

🔹 Private Company (Pty Ltd) — The most popular option. The business is its own legal entity. Your personal assets are protected if things go wrong.

Choosing the wrong structure early on can cost you a lot to fix later.

You may have heard someone mention a ""notarial deed"" and wondered what it actually is. 📋

Simply put, it is a legal document that is signed in front of a special type of attorney called a Notary. It carries more legal weight than a normal contract.

You need one for things like:
✅ An antenuptial contract before you get married
✅ A lease agreement that lasts longer than 10 years
✅ Certain rights over someone else's property
✅ Some business and trust documents

If you got married through lobola and customary traditions, your marriage is recognised by South African law — but only if it is registered. 💍

Many couples do not know this, and it can cause serious problems when it comes to inheritance, divorce or property.

Here is what you need to know:
🔹 Your customary marriage must be registered within 3 months
🔹 Both partners must be 18 or older
🔹 If a husband wants to take a second wife, he must first get approval from the court

Without registration, you may not have the legal protection you think you have.

Have you ever seen the word "usufruct" in a will and had no idea what it means? You are not alone. 🏡

Let us break it down simply.

A usufruct gives someone the right to live in or use a property — without owning it.

A common example: A man passes away and leaves his house to his children, but his wife has the right to live there for the rest of her life. She cannot sell it, but she can stay.

This comes up a lot in estates and property deals — and it can cause confusion if you do not understand it.
