Thinking of buying a property at an auction? The bargain might cost you more than you think. 🔨

Auction properties can be great deals — but they come with legal risks most buyers only discover afterwards.

Here is what you need to know:
🔴 Most auction sales are voetstoots — you buy the property as is, faults and all
🔴 You usually cannot make the sale dependent on getting a bond
🔴 The deposit and auctioneer's commission are payable immediately
🔴 You may become responsible for outstanding rates or levies
🔴 There may still be tenants — or even the previous owner — living in the property

Read the conditions of sale BEFORE auction day, not after you have won the bid.

FACT: Debt collectors must follow strict rules — and harassment is not allowed.

Here is what they may NOT do:
🔴 Threaten, intimidate or humiliate you
🔴 Contact you at unreasonable hours
🔴 Discuss your debt with your family, friends or employer
🔴 Add unauthorised fees to what you owe
🔴 Pretend to have legal powers they do not have

Owing money does not take away your dignity or your rights.

Did you know a bank or lender can be in the wrong for giving you credit you could not afford? 💳

It is called reckless lending — and the National Credit Act protects you against it.

A credit provider breaks the law if they:
🔴 Did not properly check whether you could afford the repayments
🔴 Gave you credit when the numbers clearly showed you could not manage it
🔴 Did not explain the costs and risks of the agreement to you

If a court finds that credit was granted recklessly, the agreement can be suspended — or even set aside completely.

If you are drowning in debt from loans you should never have been given, you may have more options than you think.

Renting? Your deposit is not a gift to your landlord. Here is what the law says. 🏠

Many tenants never see their deposit again — and many do not know they have rights around it.

Here is what the Rental Housing Act says:
✅ Your landlord must keep your deposit in an interest-bearing account
✅ The interest belongs to YOU
✅ A joint inspection must be done when you move in and when you move out
✅ Your deposit (plus interest) must be paid back within 7 to 21 days, depending on any damage
✅ The landlord can only deduct for actual damage — not normal wear and tear

If your landlord refuses to pay back your deposit unfairly, you have legal options.

Fake invoices, cloned supplier identities, even deepfake calls impersonating a CFO authorising a payment. These are not future problems. They are happening now.

New anti-corruption laws are being proposed that would lower the reporting threshold and place more responsibility on business owners and directors.

Lost your job? You may be able to claim from the UIF — here is how it works. 💼

The Unemployment Insurance Fund (UIF) exists to help workers when they lose their income. If you have been contributing (check your payslip), you may qualify.

You can claim if you:
✅ Were retrenched or dismissed
✅ Your contract ended
✅ You cannot work due to illness
✅ You are on maternity leave
✅ Your employer closed down

You cannot claim if you resigned by choice.

Claims can be done online at ufiling.labour.gov.za or at a Department of Labour office. Do not wait — claims must be submitted within 12 months.

If your claim has been unfairly rejected or your employer never paid your contributions over, FPS Attorneys can advise you.
