On the 7th of December 2018 Judge President Mlambo issued Practice Directive in terms of Section 14(1)(b) of the Superior Courts Act, Act 10 of 2013, read with Section 173 of The Constitution of the Republic of South Africa. The purpose of the Directive is to make provision for the constitution for a Full Court to sit at first instance, to hear and decide the matters referred to it regarding the ambiguity identified by the Judge President in Section 115 of the Legal Practice Act, Act 28 of 2014. This section deals with the admission of Advocates to the High Court of South Africa. The different interpretations of Section 115 specifically have led to conflicting judgements and this may have detrimental effects on the advocates profession as well as the Judiciary if clarity is not found. The Johannesburg Attorneys Association have launched an application with the Pretoria Attorneys’ Association and the Gauteng Attorneys’ Association to act as amici curiae to the court in this matter as we believe that there are marked similarities in the new admission process for candidate attorneys wishing to become attorneys. A Full Court will hear the matters on the 13th and 14th of February 2019. Kindly tag and share if you know a Candidate Attorney who may benefit from this information.
