In the midst of the slog of work in the early stages of rebuilding my legal practice, I secured a standout victory for one of my clients, for whom I am already providing legal services.
Context: In September 2022, the client supplied goods on credit to a company that failed to pay for years — until the matter was handed over to AKG Attorneys.
It’s critical to note that these matters are time-sensitive, as most debts prescribe after three years, and this one was on the verge of doing so. To complicate matters further, the debtor company had been liquidated and was in the final stages of deregistration, effectively closing off that avenue for debt collection.
The client handed me the file after I had already successfully handled other debt collection work for them. They were skeptical, saying, “Well, Adrian, here’s another customer who hasn’t paid us since 2022. We don’t expect much, and we’re not even sure if we should bother handing this over to you.”
But I don’t give up — neither in my personal life nor in business. I seized the opportunity with both hands, determined to do everything in my power before the client wrote off the debt.
Upon researching the case, I discovered that the original credit agreement included sureties. This was my chance to act, but I had to move quickly to ensure the client’s claim wouldn’t prescribe and become unenforceable.
Two carefully crafted letters of demand, sent on a Monday at 10:44 AM, led to something extraordinary.
At 11:09 AM — just twenty-five minutes later — I received proof of payment for the full amount from the former director of the now defunct company. Remarkably, the proof of payment was time-stamped just twenty minutes after my letters were sent.
My letters to the sureties clearly put them in a panic, especially after I conducted credit checks and discovered one had a R980,000 judgment against their name.
I imagine their conversation with the former director went something like, “Listen, I’m not going down further for your company that doesn’t even exist anymore. They’re coming after us now!”
Legal justice, signed, sealed, and delivered in twenty-five minutes — a result that’s practically unheard of in this industry. By all accounts, it’s a unicorn outcome.
The result? An ecstatic client and a deeply satisfied Adrian for devising a solution.
