VAT INCREASE

On the 21st of February 2018, the Minister of Finance announced a VAT increase from 14% to 15%, which is to come into effect as of the 1st of April 2018.

Transfer costs are subject to VAT
As such, the VAT increase will be applied to all transfer costs on properties registered on or after 1 April 2018.

Agent’s commission is subject to VAT
In the event that an Offer to Purchase reflects the agent’s commission as VAT inclusive, the commission amount (excluding VAT) cleared after 1 April 2018 will be less, as 15% VAT will be applicable and the Seller will not pay more than the amount agreed upon.

Should the commission amount agreed upon on the Agreement of Sale be stated as a percentage or a fixed amount EXCLUDING VAT, then the commission payable will be in accordance to the VAT applicable at the time of payment. `

The applicable VAT rate will be determined at the date the commission is deemed to have been earned, which is usually date of registration of the property.

Finance Minister Malusi Gigaba has announced that the VAT rate will be increased by one percentage point from 14% to 15%, which is expected to raise an additional R22.9bn for the fiscus.
