UNDERSTANDING BAIL AND FACTORS TO BE CONSIDERED

What is “Bail”?

Bail is the legal process that may allow an accused person to be released from custody while awaiting trial, subject to certain conditions



Does everyone qualify for bail?

No, not necessarily. Each case is considered based on its own facts. The Court must take all facts into account before bail is granted



What factors does a Court consider?

1. The seriousness of the offence. The schedule it falls under.
2. Whether the accused is seen as a flight risk (will the accused attempt to flee when released, or will he/she still attend Court when necessary)
3. Is there a possibility that the accused would attempt to interfere with the witnesses or the investigation


Which conditions may the Court have if bail is granted?

1. That the accused must report to the local SAPS on certain days
2. An address must be provided where the accused is residing
3. In some instances, surrendering of the accused’s passport to ensure that he/she will not attempt to flee the country

“CONTACT” VS “ PRIMARY RESIDENCE”

In South Africa, the older term “custody” is no longer used. Instead, these rights are divided into two groups being “contact” and “primary residence”

PRIMARY RESIDENCE

The primary residence of the child, is the place where the child resides in his/her day-to-day life. The parent to whom primary residence is granted, is responsible for taking care of the child’s daily routine, such as school responsibilities.


CONTACT

The parent who does not have primary residence, has the legal right to maintain a personal relationship with the child. This includes physical visits (weekends, holidays) as well as phone calls, video chats, and messaging

In this case, the best way to formalize these arrangements, would be for parents to draft a detailed Parenting Plan that outlines where primary residence would be, contact arrangements with the other times, including when there will be visitation, telephone calls, video calls, etcetera, and may also include maintenance agreements.

IN THE MATTER BETWEEN AB AND SC IN THE HIGH COURT OF PRETORIA

The Applicant AB brought an urgent application to be heard on 24 March 2026.
The Applicant sought the following relief:
- Primary residence and care of the child (JWC, born 7 March 2017) to be awarded to the
Applicant.
- Respondent (SC) to have supervised contact every alternate weekend (Sat & Sun,
10h00–14h00) under a social worker’s supervision.
- Appointment of therapist to conduct a forensic assessment of both parties and the child.
- Respondent to pay costs of the forensic assessment and application.

The Respondent, represented by Charl Albasini and Albasini Attorneys, opposed the
application on the grounds that the matter is not urgent and that AB is abusing the court process to protect herself from criminal and domestic-violence consequences due to allegations of assault against the minor child.

The Applicant claimed that the Respondent abandoned the child when he relocated to the UK, and further alleged that the Respondent’s return to SA is interfering with the minor child’s life and causing him distress.

The Respondent’s reply was that the move to the UK was originally agreed and that he stayed involved through visits, calls, and financial support.
It was brought to the Court’s attention that the Respondent’s return to SA was due to the
Applicant’s indication she could not cope with the child’s behaviour.

Applicant’s position: Seeks urgent protection, supervised contact, and expert involvement to safeguard the child.

Respondent’s position: Argues urgency is fabricated, child is not at risk, and the application is abusive; requests dismissal with costs.

On the 24th March 2026, the Court granted an Order that the Respondent’s contact to
be reinstated effective immediately; and that the parties to agree to a professional to
conduct a forensic assessment, cost of which must be split equally, whereafter they
may approach the Court again to supplement their papers.

Albasini Attorneys has once again claimed victory for our client whilst also ensuring that the best interest of the child prevails. ⚖️💫
