Cross-border insolvency continues to reshape how estates are administered in a globalised economy.

In 𝘚𝘀𝘩𝘦𝘦𝘳 𝘷 𝘞𝘒𝘨𝘯𝘦𝘳 π˜•.π˜–. 𝘒𝘯π˜₯ π˜–π˜΅π˜©π˜¦π˜³π˜΄ (1109/2024) [2026] 𝘑𝘈𝘚𝘊𝘈 32, the Supreme Court of Appeal (SCA) examined whether a surplus in a South African insolvent estate can be used to satisfy a deficit in a foreign jurisdiction.

The Court confirmed that section 116 of the Insolvency Act 24 of 1936 cannot always be applied in isolation when insolvency spans multiple jurisdictions.

A surplus in South Africa may, in appropriate circumstances, be claimed by a duly appointed foreign trustee, but only once recognised by a South African court through a formal application.
