The handshake felt real. The price was agreed.

Then the clause turned out to be vague, the certificate never arrived, and weeks later the deal quietly fell apart.

Selling property privately is legal in South Africa. It is also where most sales come undone, not from bad faith, but because the law has its own checklist that does not bend for good intentions.

Section 5(2) of the Alienation of Land Act sets four things every sale must contain. Three more documents sit behind that, any one of which can void a transfer long after everyone shook hands.

We are not here to talk anyone out of a private sale. We are here so the quiet things do not come back loud.

Save this for the friend who is about to "just do it themselves".

Every few months, an electronic will makes headlines and the internet briefly convinces itself that a Notes app counts as estate planning.
It does not.

South African law still requires a will to be written, signed at the end by the testator, and witnessed in person by two competent adults. The Electronic Communications and Transactions Act recognises digital signatures for most documents, but wills sit firmly outside its scope.

A defective will can sometimes be rescued through a High Court application, with sworn evidence of intention, but it is a route best avoided.

Johannesburg Arbitration Week 2026 | From regional dialogue to shared direction.

Mayet & Associates Attorneys was honoured to attend one of Africa’s leading arbitration gatherings, engaging with practitioners, jurists and industry leaders on the future of arbitration, trade, investment and sustainable development across the continent.

A highlight was hearing our colleague, Advocate Lintle Tuke, contribute to discussions on arbitration developments in Lesotho, alongside insightful engagements on AFSA Lesotho and regional dispute resolution frameworks. We were also privileged to hear from Judge Unterhalter of the Supreme Court of Appeal of South Africa.

It was wonderful reconnecting with our friends at Afriwise and ENS and participating in conversations shaping Africa’s evolving arbitration landscape.
