Congratulations on Your Liquor License! But What Comes Next?

Congratulations! You’ve successfully navigated the complex and often challenging process of obtaining a liquor license through the Western Cape Liquor Authority and the Western Cape Liquor Licensing Tribunal. While this is an important milestone worth celebrating, it’s essential to understand that receiving your license is just the beginning—not a free pass to operate as you please.

A liquor license is granted in terms of the Western Cape Liquor Act 4 of 2008 and comes with strict compliance requirements, rules, and regulations. Non-compliance can result in significant penalties, including heavy fines or, in serious cases, the revocation of your license.

There are many regulatory obligations that license holders must adhere to, far too many to cover in a single article. However, one increasingly common area of concern is the change in financial interest in the licensed entity.

What Does a Change in Financial Interest Mean?
In simple terms, a financial interest refers to any stake in the entity that receives the revenue from liquor sales. According to the Western Cape Liquor Act, if there is a change of more than 5% in this financial interest, a formal application must be submitted to the Western Cape Liquor Authority.

Here’s how this applies depending on the type of license holder:

Company: If the shareholding changes by more than 5%, an application is required.

Close Corporation: If there is a change in the membership, an application is required.

Why Is This Important?
Failure to submit the required application for a change in financial interest can lead to a number of serious consequences:

Applications for removal or transfer of the license may be denied.

The Liquor Authority may initiate proceedings for non-compliance.

Administrative fines may be imposed.

Your license may not be automatically renewed and a formal application will be required.

Ultimately, these issues can result in the loss of your liquor license and financial expenses.

Renewal Season has started and all Western Cape Provincial liquor licenses must be renewed on or before 31 December 2021 in order for the license to be valid for 2022 (unless biannual renewal was approved and the renewal fee was paid during end 2020 - then renewal fee payment will only be required by end 2022).

Please remember - the holder of the liquor license remains responsible for the renewal of the liquor license, even if they do not receive the renewal notice.

Renewal fees also increased on 30 October 2021. Please therefore ensure that the correct renewal fee is paid.

Technically not the first petrol station in South Africa. Maybe the first one in GP but we have had successful applications in the WCP. Also, it wasn't the petrol station who received the issued liquor license - it was Pick 'n Pay for their convenience store.
