It has come to our attention that a certain company advertises that it can help individuals to become debt-free whilst retaining all their assets, all through a sequestration. These claims are totally untrue and so far-fetched that they create the impression that unsuspecting members of the public are lured into a scam to part with their much-needed cash. Before a court will grant a sequestration order, there must be credible proof that the sequestration will be to the advantage of the insolvent's creditors. As a rule of thumb, most courts require that concurrent creditors will receive a dividend of at least 20c in the Rand from the sale of unencumbered assets. The irony is that many people would be so hopelessly insolvent by the time they opt for a sequestration that their creditors would receive virtually no dividend, meaning they would not be able to be sequestrated. If you are over-indebted it will be advisable that you seek professional advice sooner rather than later when you may find that you have nothing left to offer your creditors. What is the difference between sequestration and liquidation?

Natural persons, partnerships and trusts are sequestrated. There must be a prospect that the creditors will get a dividwd before one can be sequestrated.

Juristic entities, i.e. companies and close corporations, are liquidated. It is not neccessary to show there will be an advantage to creditors but the administration charges must be covered.
