We are currently handling a similar case, with the defaulting party hiding in France. There comes a time that your default will catch up with you.

The Gauteng High Court, Johannesburg, again proved that the courts will not tolerate parents who simply ignore a maintenance order and placed the man under final sequestration.

On 13 May 2022 the Pretoria High Court handed down judgment in the matter of Greyling v Minister of Home Affairs and others (40023/21) [2022] ZAGPPHC 3 and found certain sections of the Divorce Act, No. 70 of 1979 to be unconstitutional.

The court found that Section 7(3)(a) of the Divorce Act is inconsistent with the Constitution and invalid to the extent that the provision limits the operation of Section 7(3) of the Divorce Act to marriages out of community of property entered into before 1 November 1984 and that the words ‘entered into before the commencement of the Matrimonial Property Act, 1984 in section 7(3)(a) of the Divorce Act, 70 of 1979, is declared inconsistent with the Constitution and invalid and notionally severed.

Today the Constitutional Court heard this matter and judgment has been reserved. We await the judgment, which will have a huge impact on our divorces law.

A man has lost out on his portion of his wife’s state pension, their house and all of which formed part of their joint estate because he never contributed towards the household during their marriage.

Interesting ruling.

The South Gauteng High Court in Johannesburg ruled that a customary marriage between a black man and coloured woman was valid after the woman’s family argued that due to her ethnicity, customary marriage would have been impossible.
