Dear Friends and Colleagues,
You are all aware that the Hon’ble LG of Delhi, Sh. V.K. Saxena, has recently issued a notification permitting Delhi Police officials to depose from their police stations instead of appearing in person before the courts.
This is not only arbitrary and unconstitutional but also a direct assault on the principles of natural justice. The physical presence of a police witness in court is the foundation of fair trial and cross-examination. If the police are allowed to sit comfortably in their stations and give evidence, it will open the floodgates of manufactured testimonies, doctored depositions, and wrongful convictions.
We know the ground reality—Delhi Police is already infamous for framing innocents in false and fabricated cases. This notification will make them feel supreme, unaccountable, and beyond judicial scrutiny. Once police officers stop coming to court, there will be no fear of accountability and no check on their misuse of power.
Moreover, during video depositions, it will be impossible to know whether the witness is being prompted, aided by documents, or even guided by colleagues sitting next to him. This is nothing but a mockery of cross-examination and a deathblow to fair trial rights.
Colleagues, let us be clear: Very few advocates support BJP today, and such actions will further alienate the Bar from them. This agitation, if not resisted, will cost BJP dearly in the long run. The LG, behaving like a dictator, needs to be reminded that Delhi is run by BJP and not by Kejriwal. Someone should tell this donkey to wake up from his sleep and behave like a man and not a donkey.
Friends, the Bar has always been the vanguard against authoritarianism. We must not stay silent today. I call upon all of you to unite and oppose this unconstitutional notification tooth and nail, so that justice is not reduced to a mockery at the hands of police and political masters.
