Is the question presented in the Tayam petition justiciable? or a political one?. Here's my take as a lawyer. The question presented in the Tayam petition involves the determination of quorum in the recent session of Senate (June 03, 2026) where 12 senators were present and declared the existence of quorum to proceed with its regular legislative agenda, and going as far as declaring vacant the membership of Senate committees and the Office of the Senate President.

The petition raised the question whether the 12 senators present on that session day constituted a quorum?. This alone would necessarily call for the interpretation of the Constitution which is a question of law, therefore, a justiciable one.

The dismissal of the petition was based on the lack of legal standing of the petitioner and not on the fact whether the question raised therein is a political question. Such determination falls within the realm of the high court's expanded power of judicial review to curtail the abuses of the executive and legislative branch of the government on justifying their official acts as one of political question, hence, beyond the reach of the courts.

Before engaging the legal services of a lawyer, first and foremost, verify their professional legitimacy. The lawlist of the Supreme Court of the Philippines provides for the online list of all members of the Philippine Bar. The list is up to date. In this world and age full of deception and misrepresentation, you can protect yourself by doing a few verification steps. Wag magpaloko. Only engage legitimate lawyers.

Lawyer Diaries:

Rendered my first legal advice pro bono without view of attorney-client engagement.

Earlier this morning, I received a message request on Facebook messenger. A woman who is suffering from stage 5 CKD. Her problem was about her insurance claim against the recruitment agency that hired her for overseas employment in 2023 and subsequently got into a work-related accident

Sadly, when she filed a complaint at the Department of Migrant Workers (DMW), the recruitment agency defrauded her into signing an agreement tahat only her airfare would be paid. She was never assisted by DMW staff before signing the agreement. No payment of insurance claim neither backwages whatsoever was made because the accident was not work related. As a lawyer, I explained the law and procedure to the woman and guided her step by step on what to do next.

Reflection: As lawyers, we have the solemn duty of service first to our country and fellow countrymen. To them we owe the privilege of wearing our title. Some, if not most of us, rush in to thinking of earning money in practicing our profession due to our own personal obligations. This is what I realized today. We must balance in serving our own personal interest, and our civic duty to others in this enduring profession.

Nakasaad sa Saligang Batas (Art. III, Sec. 3(1)) (Bill of Rights) ang karapatan ng bawat Pilipino na maging protektado sa kanilang pribadong komunikasyon at mga liham na personal. Ang karapatang ito ay maaari lamang ma-limitahan kung may kautusan mula sa mga korte, o kaya naman kung ang kaligtasan ng publiko ay maaring maapektuhan sa hindi pagsasalathala ng naturang komunikasyon o liham.

Ayon sa mga landmark case na dinesisyunan ng Korte Suprema na patungkol sa mga pag labag sa mga karapatang pantao sa Saligang Batas, bawat pilipino ay may tinatawag na "reasonable expectation of privacy", o mga lugar, espasyo o bagay na pribado sa pamantayan ng lipunan. Tulad na lang ng mga social media account; ang owner ay may reasonable expectation of privacy sa nilalaman ng account.

Kaya may legal na batayan ang pag tanggi kung hinihingi ang iyong social media account lalo na ang username at password. At lalo na ang pagkakaroon ng relasyon ay hindi justification para ma labag ang karapatang ito na na protektado sa ilalim ng Saligang Batas.
