🚨 پشاور ہائی کورٹ میں نیشنل ہائی ویز کے ٹول ٹیکس کے خلاف اہم آئینی درخواست پر پیش رفت
عوامی مفاد سے متعلق ایک نہایت اہم آئینی درخواست پشاور ہائی کورٹ میں دائر کی گئی ہے، جس میں نیشنل ہائی ویز پر سرکاری ملازمین اور روزانہ سفر کرنے والے شہریوں سے بار بار وصول کیے جانے والے ٹول ٹیکس کی قانونی حیثیت، آئینی جواز اور منصفانہ اطلاق کو چیلنج کیا گیا ہے۔
درخواست میں مؤقف اختیار کیا گیا ہے کہ ٹول ٹیکس میں مسلسل اضافہ، بعض مخصوص سرکاری عہدیداروں کو استثنیٰ دینا، مختلف سرکاری ملازمین کے ساتھ غیر مساوی سلوک، ڈیوٹی سلپ پالیسی کی قانونی حیثیت، اور آئینِ پاکستان میں دیے گئے مساوات، شفافیت اور آزادانہ نقل و حرکت کے بنیادی اصولوں کی خلاف ورزی جیسے اہم آئینی سوالات عدالت کے سامنے رکھے گئے ہیں۔
مزید یہ کہ درخواست میں نشاندہی کی گئی ہے کہ سرکاری فرائض کی انجام دہی کے لیے قومی شاہراہوں پر سفر کرنے والے نچلے اور متوسط طبقے کے سرکاری ملازمین پر ٹول ٹیکس کی صورت میں غیر متناسب مالی بوجھ عائد کیا جا رہا ہے، جو انصاف اور مساوات کے تقاضوں کے منافی ہے۔
اس مقدمے کی سماعت کے دوران درخواست گزاروں کی جانب سے ایڈووکیٹ سعد خان اور ایڈووکیٹ ابرار الحق نے پشاور ہائی کورٹ میں مؤثر انداز میں دلائل پیش کیے۔
معزز پشاور ہائی کورٹ نے ابتدائی سماعت کے بعد درخواست کو قابلِ سماعت قرار دیتے ہوئے وفاقِ پاکستان، نیشنل ہائی وے اتھارٹی (NHA) اور دیگر متعلقہ حکام سے کمنٹس/جوابات طلب کر لیے ہیں، جو آئندہ سماعت پر عدالت میں پیش کیے جائیں گے۔
یہ مقدمہ صرف ٹول ٹیکس کا نہیں بلکہ قانون کی بالادستی، مساوی سلوک، عوامی احتساب اور عوامی خدمت انجام دینے والے سرکاری ملازمین کے آئینی حقوق کا مقدمہ ہے، جس کے اثرات لاکھوں شہریوں اور سرکاری ملازمین پر مرتب ہو سکتے ہیں۔
