Hiện nay, Việt Nam đã mở rộng chính sách cấp thị thực điện tử cho công dân tất cả các quốc gia và vùng lãnh thổ. Việc đơn giản hóa thủ tục cấp thị thực đã tạo điều kiện thuận lợi cho người nước ngoài nhập cảnh vào Việt Nam để du lịch, thăm thân, đầu tư, thương mại, làm việc và các mục đích hợp pháp khác. Tuy nhiên, trên thực tế vẫn còn nhiều trường hợp người nước ngoài sử dụng thị thực điện tử không đúng mục đích hoặc chưa thực hiện đầy đủ các thủ tục pháp lý liên quan đến lao động tại Việt Nam.
1. Người nước ngoài nhập cảnh bằng E-visa để làm việc tại Việt Nam
Theo quy định của pháp luật Việt Nam, người nước ngoài vào Việt Nam làm việc cho cơ quan, tổ chức, doanh nghiệp phải đáp ứng đầy đủ các điều kiện về xuất nhập cảnh, cư trú và lao động.
Trường hợp người nước ngoài làm việc tại Việt Nam theo hình thức lao động, cơ quan, tổ chức, doanh nghiệp sử dụng lao động có trách nhiệm thực hiện các thủ tục liên quan theo quy định của pháp luật, bao gồm thủ tục mời, bảo lãnh, cấp thị thực, thẻ tạm trú (nếu thuộc trường hợp phải thực hiện) và các thủ tục về giấy phép lao động hoặc xác nhận không thuộc diện cấp giấy phép lao động theo quy định của pháp luật lao động.
Nghị định số 282/2025/NĐ-CP của Chính phủ quy định xử phạt vi phạm hành chính trong lĩnh vực an ninh, trật tự đã bổ sung và hoàn thiện các chế tài xử lý đối với hành vi vi phạm quy định về nhập cảnh, xuất cảnh, cư trú và hoạt động của người nước ngoài tại Việt Nam. Do đó, các cơ quan, tổ chức, doanh nghiệp cần thực hiện đầy đủ trách nhiệm quản lý người nước ngoài theo quy định để tránh các rủi ro pháp lý có thể phát sinh.
2. Người nước ngoài sử dụng E-visa nhưng hoạt động không đúng mục đích nhập cảnh
Theo quy định của pháp luật Việt Nam, người nước ngoài phải hoạt động đúng với mục đích nhập cảnh đã khai báo và phù hợp với loại thị thực được cấp.
Trên thực tế, có trường hợp người nước ngoài khai báo mục đích nhập cảnh là du lịch, thăm thân hoặc mục đích khác nhưng sau khi nhập cảnh lại trực tiếp làm việc cho doanh nghiệp, tổ chức tại Việt Nam. Đây là hành vi tiềm ẩn nguy cơ vi phạm các quy định về xuất nhập cảnh và lao động.
Ví dụ:
- Người nước ngoài nhập cảnh bằng thị thực điện tử nhưng thực tế làm việc cho cơ quan, tổ chức, doanh nghiệp tại Việt Nam mà không thực hiện đầy đủ thủ tục về lao động theo quy định;
- Lợi dụng chính sách thị thực điện tử có thời hạn đến 90 ngày để cư trú, làm việc kéo dài tại Việt Nam mà không được cấp giấy phép lao động hoặc không thuộc diện miễn giấy phép lao động theo quy định;
- Sử dụng thị thực điện tử để thực hiện các hoạt động trái pháp luật khác như tổ chức, tham gia các hành vi vi phạm pháp luật về an ninh mạng, tội phạm công nghệ cao hoặc các hành vi vi phạm pháp luật khác trên lãnh thổ Việt Nam.
Trong các trường hợp nêu trên, người nước ngoài có thể bị xử lý vi phạm hành chính theo quy định của Nghị định số 282/2025/NĐ-CP. Tùy theo tính chất, mức độ vi phạm, cơ quan có thẩm quyền có thể áp dụng các biện pháp xử lý bổ sung theo quy định của pháp luật.
Bên cạnh đó, cơ quan, tổ chức, doanh nghiệp sử dụng người nước ngoài không đúng quy định cũng có thể bị xem xét xử lý trách nhiệm theo quy định hiện hành.
3. Người nước ngoài cần làm gì khi nhập cảnh bằng E-visa nhưng có nhu cầu làm việc tại Việt Nam?
Trong thực tế, không ít trường hợp người nước ngoài nhập cảnh vào Việt Nam bằng thị thực điện tử với mục đích du lịch, thăm thân hoặc thương mại, sau đó phát sinh nhu cầu làm việc cho cơ quan, tổ chức, doanh nghiệp tại Việt Nam.
Để bảo đảm đúng quy định của pháp luật, người nước ngoài và đơn vị sử dụng lao động cần chủ động thực hiện các thủ tục liên quan đến lao động và xuất nhập cảnh theo quy định hiện hành. Trong đó, người nước ngoài phải được cấp giấy phép lao động hoặc có văn bản xác nhận không thuộc diện cấp giấy phép lao động theo quy định của pháp luật lao động trước khi thực hiện các thủ tục liên quan đến thị thực hoặc thẻ tạm trú.
Sau khi đáp ứng đầy đủ các điều kiện theo quy định, người nước ngoài có thể được xem xét cấp thị thực hoặc thẻ tạm trú phù hợp với mục đích lao động.
Việc chủ động hoàn thiện hồ sơ pháp lý ngay từ đầu không chỉ giúp người nước ngoài bảo đảm quyền và lợi ích hợp pháp trong quá trình làm việc tại Việt Nam mà còn hạn chế nguy cơ phát sinh vi phạm hành chính trong lĩnh vực xuất nhập cảnh và lao động.

- Người nước ngoài cần khai báo trung thực mục đích nhập cảnh khi đề nghị cấp thị thực điện tử và chỉ thực hiện các hoạt động phù hợp với mục đích đã được cấp thị thực.
- Đối với các cơ quan, tổ chức, doanh nghiệp sử dụng lao động nước ngoài, cần chủ động thực hiện đầy đủ các thủ tục về bảo lãnh, giấy phép lao động, thị thực, thẻ tạm trú và các thủ tục liên quan khác theo quy định của pháp luật Việt Nam.
- Việc tuân thủ đúng các quy định của pháp luật không chỉ bảo đảm quyền và lợi ích hợp pháp của người nước ngoài, doanh nghiệp sử dụng lao động mà còn góp phần nâng cao hiệu quả công tác quản lý người nước ngoài tại Việt Nam.

FOREIGNERS USING E-VISAS TO WORK IN VIETNAM: IMPORTANT LEGAL CONSIDERATIONS
An electronic visa (E-visa) is a visa issued by a competent Vietnamese authority to foreign nationals through an electronic transaction system. Pursuant to Clause 2, Article 9 of the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam, an E-visa is valid for up to 90 days and may be issued for either single or multiple entries.
Vietnam has expanded its E-visa policy to citizens of all countries and territories. The simplification of visa procedures has facilitated foreigners entering Vietnam for tourism, family visits, investment, business, employment, and other lawful purposes. However, in practice, there remain cases where foreigners use E-visas for purposes inconsistent with their declared objectives or fail to complete the legal procedures required for employment in Vietnam.
1. Foreigners Entering Vietnam with an E-Visa for Employment Purposes
Under Vietnamese law, foreigners working for agencies, organizations, or enterprises in Vietnam must fully satisfy all requirements relating to entry, residence, and employment.
Where a foreign national works in Vietnam as an employee, the sponsoring agency, organization, or enterprise is responsible for carrying out all relevant procedures in accordance with the law, including invitation and sponsorship procedures, visa issuance, temporary residence card issuance (where applicable), and procedures for obtaining a work permit or confirmation of exemption from a work permit as prescribed by labor legislation.
Government Decree No. 282/2025/ND-CP on administrative sanctions in the fields of security and public order has strengthened and supplemented sanctions for violations relating to the entry, exit, residence, and activities of foreigners in Vietnam. Therefore, agencies, organizations, and enterprises must fulfill their responsibilities in managing foreign nationals in accordance with the law in order to avoid potential legal risks.
2. Foreigners Using E-Visas for Purposes Inconsistent with Their Declared Purpose of Entry
Vietnamese law requires foreign nationals to engage only in activities consistent with the purpose of entry declared in their visa application and with the type of visa granted.
In practice, some foreigners declare their purpose of entry as tourism, family visits, or other purposes, but subsequently work directly for enterprises or organizations in Vietnam. Such conduct may constitute a violation of regulations governing immigration and employment.
Examples include:
Entering Vietnam with an E-visa but actually working for an agency, organization, or enterprise without completing the required labor procedures;
Taking advantage of the E-visa policy, which allows stays of up to 90 days, to reside and work in Vietnam for an extended period without obtaining a work permit or qualifying for a work permit exemption;
Using an E-visa to engage in unlawful activities, including organizing or participating in cybercrime, high-tech crime, or other violations of Vietnamese law.
In such cases, foreign nationals may be subject to administrative penalties in accordance with Decree No. 282/2025/ND-CP. Depending on the nature and severity of the violation, competent authorities may impose additional measures as provided by law.
Furthermore, agencies, organizations, and enterprises employing foreign nationals in violation of legal regulations may also be held liable in accordance with applicable laws.
3. What Should Foreigners Do If They Enter Vietnam with an E-Visa but Later Wish to Work?
In practice, many foreigners enter Vietnam with an E-visa for tourism, family visits, or business purposes and subsequently wish to work for agencies, organizations, or enterprises in Vietnam.
To ensure compliance with Vietnamese law, both foreign nationals and their employers should proactively complete all procedures relating to labor and immigration in accordance with current regulations. In particular, a foreign national must obtain a work permit or a certificate confirming exemption from a work permit under labor laws before carrying out procedures related to visas or temporary residence cards.
Once all legal requirements have been satisfied, the foreign national may be considered for the issuance of an appropriate visa or temporary residence card corresponding to the intended employment purpose.
Proactively completing the necessary legal procedures from the outset not only helps protect the lawful rights and interests of foreign nationals during their employment in Vietnam but also minimizes the risk of administrative violations in the fields of immigration and labor.
Recommendations from the Hanoi Immigration Office
The Hanoi Immigration Office recommends that:
- Foreign nationals truthfully declare their purpose of entry when applying for an E-visa and engage only in activities consistent with the purpose for which the visa was granted;
- Agencies, organizations, and enterprises employing foreign nationals proactively complete all procedures relating to sponsorship, work permits, visas, temporary residence cards, and other relevant requirements under Vietnamese law;
- Compliance with Vietnamese law not only protects the lawful rights and interests of foreign nationals and employers but also contributes to improving the effectiveness of foreigner management in Vietnam.

外国人持电子签证(E-Visa)在越南工作:需要注意的法律问题
电子签证(E-Visa)是越南主管机关通过电子交易系统向外国人签发的一种签证。根据《越南外国人入境、出境、过境和居留法》第9条第2款的规定,电子签证最长有效期为90天,可签发一次入境或多次入境。
目前,越南已将电子签证政策扩大至所有国家和地区的公民。签证申请手续的简化,为外国人赴越旅游、探亲、投资、商务、工作以及其他合法目的提供了便利。然而,在实践中,仍有部分外国人未按照申报目的使用电子签证,或者未依法办理在越工作的相关法律手续。
一、持电子签证(E-Visa)入境越南工作的外国人
根据越南法律规定,外国人在越南为机关、组织、企业工作,必须满足有关入境、居留及劳动管理的各项法律要求。
外国人以劳动就业形式在越南工作的,用人单位有责任依法办理相关手续,包括邀请、担保、签证申请、暂住证申请(如适用),以及根据劳动法律规定办理工作许可证(Work Permit)或工作许可证豁免确认手续。
越南政府颁布的第282/2025/NĐ-CP号法令(关于安全、社会秩序领域行政处罚规定)进一步完善了针对外国人在越南入境、出境、居留及活动违法行为的处罚规定。因此,各机关、组织和企业应严格履行对外国人的管理责任,避免产生不必要的法律风险。
二、持电子签证入境但从事与申报入境目的不符活动的情形
根据越南法律规定,外国人应按照其申报的入境目的以及所获签证类别从事相应活动。
实践中,部分外国人在申请电子签证时申报的入境目的为旅游、探亲或其他目的,但入境后却直接为越南企业、组织工作。这类行为存在违反越南出入境管理及劳动管理法律规定的风险。
例如:
持电子签证入境后,实际为越南机关、组织或企业工作,但未依法办理劳动手续;
利用电子签证最长90天的政策,在未取得工作许可证或不属于工作许可证豁免范围的情况下,长期在越南居留和工作;
利用电子签证从事其他违法活动,例如组织、参与网络安全违法犯罪、高科技犯罪或者其他违反越南法律的行为。
对于上述情形,外国人可能依据第282/2025/NĐ-CP号法令受到行政处罚。根据违法行为的性质和严重程度,主管机关还可以依法采取其他补充处理措施。
此外,违法使用外国劳动力的机关、组织和企业,也可能依据现行法律规定承担相应法律责任。
三、持电子签证入境后有意在越南工作的外国人应当如何办理?
在实践中,不少外国人以旅游、探亲或商务等目的持电子签证入境越南后,产生了在越南机关、组织或企业工作的需求。
为确保符合法律规定,外国人及其用人单位应主动按照现行规定办理与劳动和出入境管理相关的手续。其中,外国人应根据劳动法律规定,在办理签证或暂住证相关手续之前,取得工作许可证或者工作许可证豁免确认文件。
在满足相关法律条件后,外国人可根据其实际工作目的申请相应类别的签证或者暂住证。
提前完善相关法律手续,不仅有助于保障外国人在越南工作期间的合法权益,也有助于避免因违反出入境和劳动管理规定而受到行政处罚。

外国人在申请电子签证时,应如实申报入境目的,并仅从事与签证目的相符的活动;
