Để hiện đại hóa công tác quản lý xuất nhập cảnh, đồng thời nâng cao chất lượng phục vụ hành khách theo hướng nhanh chóng – thuận tiện – an toàn, Cục Quản lý Xuất nhập cảnh Việt Nam chính thức áp dụng quy định mới đối với hành khách nhập cảnh qua Sân bay Quốc tế Tân Sơn Nhất như sau:

👥 1. Đối tượng áp dụng
1. Applicability

Quy định này bắt buộc áp dụng đối với:

🔹 Hành khách mang quốc tịch nước ngoài nhập cảnh vào Việt Nam
Foreign nationals entering Vietnam.
🔹 Người Việt Nam định cư ở nước ngoài (kiều bào) sử dụng thị thực (visa) để nhập cảnh
Overseas Vietnamese entering Vietnam using a visa.

📌 Không áp dụng đối với:
Exemptions (Not applicable to):
• Công dân Việt Nam sử dụng hộ chiếu Việt Nam
Vietnamese citizens using a Vietnamese passport.
• Hành khách chỉ quá cảnh (transit), không làm thủ tục nhập cảnh
Transit passengers who do not undergo immigration clearance.


📌 2. Nội dung quy định mới
Details of the New Regulation

📅 Thời gian áp dụng: Từ ngày 15/04/2026
Effective Date: From April 15, 2026.

Theo Công văn số 1474/CACK TSN, hành khách thuộc diện áp dụng cần thực hiện:
According to Official Dispatch No. 1474/CACK TSN, applicable passengers are required to:

👉 Khai báo đầy đủ thông tin cá nhân trước khi đến cửa khẩu nhập cảnh
Fully declare personal information prior to arriving at the immigration checkpoint.

👉 Sau khi hoàn tất khai báo, hệ thống sẽ cấp mã QR xác nhận
Upon successful completion of the declaration, the system will generate a confirmation QR code.

👉 Xuất trình mã QR cho cán bộ kiểm soát tại Công an cửa khẩu – Sân bay Quốc tế Tân Sơn Nhất khi làm thủ tục nhập cảnh
Present this QR code to the immigration officer at Tan Son Nhat International Airport during clearance procedures.

CAN FOREIGNER APPLY FOR A VIETNAM WORK PERMIT WITHOUT A UNIVERSITY DEGREE?

This is a question we receive a lot from our customers during the consulting process. So, we hope this article clarifies your question.

As you may aware, Work permit procedure requires a lot of documents, including foreigner's qualifications/experience documents, Criminal record, Health certificate, documents from the sponsor company, and so on. Each job position has its own specific requirements in terms of professional qualifications, degrees/certificates, and experience. Therefore, depending on your position/job title, you need to provide the UNIVERSITY DEGREE and WORK EXPERIENCE LETTER, specifically as follows:

👉 For Foreign Experts:

o Having a bachelor’s degree or higher or equivalent and have at least 3 years of experience working in the trained field relevant to the job position the foreign worker is expected to work for in Vietnam; and

o Having at least 3 years of experience relevant to the job the foreign worker is expected to work in Vietnam.

In short, if you apply for a Work permit as an Expert, you need to provide the UNIVERSITY DEGREE and WORK EXPERIENCE LETTER. If the above-mentioned documents are issued by foreign authorities, they must be applied for the consular legalization.

👉 For Technical workers:

o An individual that has been training in a technical field or another major for at least one year and has been working for at least three years in their trained field, with the stamp of consular legalization; or

o Having at least five years’ experience related to the job for which they will be employed in Vietnam.

This means you can provide a College Degree or Training Certificate to apply for a Work permit as a Technical worker.

👉 For executives, managers:

University degrees are not included in the list of mandatory required documents for executives/ managers position. Correspondingly, documents of foreign workers proving that they are managers and executives include:

o Decision for Appointment;

o Company’s Business registration certificate;

o Company’s Charter

Thus, you do not need to provide the UNIVERSITY DEGREE and WORK EXPERIENCE LETTER to apply for a Work permit as a Manager of the company.

🇻🇳 What is Vietnam Visa approval letter?

“Vietnam Visa approval letter” is a document issued by Vietnam Immigration Department. It functions as an official permission allowing its owner to board the flight to Vietnam and get visa stamped onto the passport upon arrival at Vietnam’s international airport.

🕗 How long does it take to get the “approval letter”?

In normal cases, you will receive the approval letter after 3-4 working days - for tourist visa, or 7-10 working days - for business visa (excluding Saturday, Sunday, and National Holidays).

🛩 Can I get a “Vietnam Visa approval letter” while I'm still in Vietnam?

Previously, you could apply for the “Vietnam Visa approval letter” while you were still in Vietnam, but now this is not possible.

You need to leave the country, then while you are abroad, the Department of Immigration will process the application and issue the “Vietnam Visa approval letter”. This process takes at least 2 working days, which means you need to be abroad for 2 working days. Once the letter has been issued, you can return to Vietnam and get the visa stamp at the airport or landport.

🤷‍♂️ Can I apply for a “Vietnam Visa approval letter” myself?

You can apply yourself to get the approval letter for a Tourist visa/ Evisa. But if you want to have a business visa to work in Vietnam, you need a sponsor company, which will prepare the application to submit to the Department of Immigration. You cannot apply for the approval letter for the business visa on your own.

🆘 What if my Vietnam visa is about to expire?

If your visa is a Tourist visa, you will not be able to extend it. You have to leave Vietnam and apply for a new re-entry visa. You can do a "run visa", which is to exit through the nearest land border gate and return the same day. But you need to make sure that you have a new “Vietnam Visa approval letter” before re-entering the country.

If your visa is a business visa and it is about to expire, you can get it renewed without leaving the country. Depending on the Immigration Department where you live, they may allow you to extend once or twice, for 1 month or 3 months each time. You should do it at least 10 days in advance.

Nowaday, Vietnam Visa On Arrival is one of best choice for who visit Vietnam and want to save time to get Vietnam visa.

🇻🇳 WHAT IS VISA ON ARRIVAL?

Vietnam visa on arrival (VOA) or Landing visa is a legit visa type that allows foreigners to collect a visa upon entry to enter and exit Vietnam. If visa at Embassy and e-visa is available for many ports including airport, landport, and seaport, visa on arrival is only available for those who enter Vietnam by air and at one of 8 given international airports in Vietnam.

(*) 8 international airports allowing business visas on arrival in Vietnam include Noi Bai Airport, Cat Bi Airport, Danang Airport, Cam Ranh Airport, Lien Khuong Airport, Phu Quoc Airport, Can Tho Airport, and Tan Son Nhat Airport.

Instead of getting a visa affixed to passports in advance of the trip, applicants are required to apply for a visa approval letter (also known as pre-approved visa letter or visa invitation letter) via a local visa agency in Vietnam first, then this letter is used to take a visa stamp on the passport upon arrival at the airport.

As its name implies, visa-on-arrival is usually known for its convenience, especially for those who cannot go to the Embassy/Consulate in their country to apply for a visa. Besides, there are a bunch of pros you may not know:

• Convenience: No need to prepare many documents to submit in person at the Embassy, no passport sendoff, Vietnam Landing visa only requires some information for the application form and pre-approved visa letter. Then, the visa stamp will be provided upon your entry. The visa approval letter process is conducted easily online with the support of the local agency.

• Time-saving: Visa on arrival is best for those who do not have time to go to the Embassy. Moreover, this type of visa is best for emergency cases. The urgent visa application may take only 4 - 5 hours.

• Cost-saving: Document preparation fee, postage fee to send documents, or travel costs to the Embassy will be cut off with visa-on-arrival. You just need to pay a stamping fee at the airport to get a visa to Vietnam.

• Various entry types: Multiple entries are available compared with a single entry for an E-visa (tourist visa, work/labour visa, visa to visit relatives, etc).

✈️ Conditions / Applicable laws if you want to get a BUSINESS LANDING VISA

Foreigners who will enter Vietnam for business purposes have to apply for a Vietnam Business Visa ( also known as a Vietnam DN Visa).
The Business Visa for Vietnam is a short-term visa, issued to foreigners who will be working with a company in Vietnam, attending a meeting/negotiation, signing a contract, etc but who do not have a work permit.
Although citizens all over the world can apply for a Business Landing visa if they travel to Vietnam by air and enter/exit one of 8 designated airports, there are some other conditions that you must comply with as below:

• Foreigners coming from a country without the Vietnam Embassy/Consulate.

• Foreigners residing in other countries and currently not present in the Vietnam territory.

• Foreigners having valid passports with at least 6 months validity in advance of the planned stay in Vietnam.

• Foreigners coming to Vietnam by air and having the entry/exit checkpoints at one of 8 international airports allowing visa-on-arrival.

• Those who are not banned from entering Vietnam as prescribed in Article 21 of the Law on entry, exit, transit and residence of foreigners in Vietnam.

🕗 Processing time

Since the pre-approved visa letter is compulsory for a Vietnam visa on arrival, you need to estimate the time to prepare this paper in advance of your trip. Besides, some of nations are in the special nation list of Vietnam Immigration Department, so it’s so hard to proceed visa for them, that’s why the visa procedures is more difficult and higher fee than the others. Thus, the processing time for a pre-approved visa letter varies from 5-10 working days.

🔍 Vietnam Visa on Arrival Fees

NEW REGULATIONS ON WORK PERMITS

On September 18, 2023, the Government issues Decree No. 70/2023/ND-CP on amending and supplementing a number of Articles of Decree No. 152/2023/ND-CP on foreign workers in Vietnam and recruitment and management of Vietnamese workers working for foreign organizations and individuals in Vietnam.

Decree 70/2023 prescribes many new regulations that create favorable conditions for foreign workers in Vietnam.

🔑Key Changes

1. Rewording of the definition of “Executive director” as below:
+ either the head of the branch, representative office or business location of the enterprise or
+ the person who directly administers at least one field of the agency, organization or enterprise and is under the direct direction and administration of the head of the agency, organization or enterprise.

2. New details are provided on the eligibility criteria to justify the category of “Manager” and “Executive”. This includes:
+ The company’s charter or operation regulations of agencies, organizations or enterprises;
+ Certificate of enterprise registration or certificate of establishment or establishment decision or other document of equivalent legal validity;
+ Resolutions or decisions on appointment of agencies, organizations or enterprises.

3. New details are provided on the eligibility criteria to justify the category of “Expert” and “Technical worker”. This includes:
+ Diplomas or certificates
+ Written certification of the overseas agency, organization or enterprise indicating the number of years of experience or previously issued Vietnam work permits or work permit exemption certificates that have been granted.
This means Decree 70 allows a foreigner to use her previous work permit (sponsored by another employer) to prove her working experience. This new regulation resolves many employers' complaints and supports a foreigner's burden of proof to show experience.
4. Applications for new Work Permit after 2 completed terms for experts and technical workers no longer requires work experience letter, degree and police clearance certificate.

5. Labor market testing requirement applicable from January 1, 2024: at least 15 days prior to the request for foreign labor demand, the sponsoring entity shall submit the recruitment announcement for Vietnamese workers to the positions where the entity expects to recruit foreign national through the portal of MOLISA, DOLISA, or the Employment Service Center of the provincial People’s Committee. The content of the recruitment announcement includes: position and job title, job description, number, qualification requirements, experience, salary, duration and work location.

6. Simplification of the procedures in the event of a company name change (with the same enterprise number): Work permit re-issuance should be accepted in such case instead of having to re-obtain a foreign labor demand approval and a new work permit.

7. Passport requirement for work permit: copy of passport certified by the company shall be accepted in lieu of a notarized copy by Notary Office.

8. This Decree repeals the first paragraph “Granting, re-granting, extending and revoking work permits for foreign workers in industrial parks and economic zones and certifying foreign workers’ eligibility for exemption from work permit”. Accordingly, the provincial-level Departments of Labor, Invalids and Social Affairs shall manage foreign workers in areas.

9. A foreigner married to a Vietnamese citizen can apply for work permit exemption
Prior to Decree 70, a prospective employer was required to notify the labor authorities of a prospective foreign employee's exemption from a work permit if she were married to a Vietnamese citizen. In such circumstances, there were no certificates nor confirmations on exemption from work permits. As a result, the foreigner's visas or temporary residence card ("TRC") was sponsored by the Vietnamese spouse, not the employer. Such a family-related TRC/visa is not perfect and can require some foreigners to leave Vietnam every 6 months.

Decree 70 now allows an employer to obtain a certificate of exemption from a work permit for a foreigner who is married to a Vietnamese citizen. Based on this certificate, the employer can sponsor the work-related TRC/visas all of which will permit its foreign employees to stay long term (more than 6 months). They will not have to use the family relationship to support this work requirement.

Decree No. 70/2023/ND-CP takes effect on September 18, 2023.
