Tại Việt Nam, việc bán thuốc online cũng đã diễn ra từ nhiều năm nay, người mua chỉ cần gọi điện hoặc nhắn tin đặt hàng và thuốc sẽ được giao đến tận nhà. Xuất phát từ thực tiễn đó, Luật Dược 2016 được sửa đổi, bổ sung năm 2024 đã chính thức cho phép cơ sở kinh doanh dược được bán thuốc online kể từ ngày 1-7-2025.

Tuy nhiên, khác với các mặt hàng tiêu dùng thông thường, dược phẩm là hàng hóa đặc biệt, ảnh hưởng trực tiếp đến sức khỏe và tính mạng của con người. Chính vì vậy, khâu bảo quản và vận chuyển thuốc là bài toán cần được giải quyết để hạn chế tối đa nguy cơ mất an toàn.

THEO HỢP ĐỒNG FIDIC VÀ THỰC TIỄN TẠI VIỆT NAM

Trong xây dựng, các mẫu hợp đồng Liên đoàn Quốc tế các Kỹ sư Tư vấn (FIDIC) công bố đã trở thành chuẩn mực quốc tế được sử dụng rộng rãi tại nhiều quốc gia. Trong đó, Quyển Đỏ (cho công trình xây dựng và kỹ thuật do chủ đầu tư thiết kế), Quyển Vàng (đối với thiết bị công trình và thiết kế – xây dựng), và Quyển Bạc (cho dự án EPC) thường được sử dụng phổ biến. Tại Việt Nam, Quyển Đỏ phiên bản năm 1999 (sau đây gọi là FIDIC Quyển Đỏ 1999) được sử dụng rộng rãi hơn cả vì tính tương thích và phù hợp với thị trường xây dựng.

Một trong những điều khoản có ý nghĩa thực tiễn quan trọng nhưng cũng thường phát sinh tranh chấp trong quá trình thực hiện hợp đồng xây dựng là điều khoản về thiệt hại do chậm trễ được quy định tại Điều 8.7 Quyển Đỏ FIDIC 1999. DAMAGES FOR DELAY IN CONSTRUCTION
UNDER FIDIC CONTRACTS AND PRACTICE IN VIETNAM

In construction, the suite of construction contract published by the International Federation of Consulting Engineers (“Fédération Internationale des Ingénieurs – Conseils” abbreviated as FIDIC) have become internationally recognized and widely used across numerous jurisdictions. Among these, the Red Book (for building and engineering works designed by the Employer), the Yellow Book (for Plant and Design-Build contracts), and the Silver Book (for EPC/Turnkey Projects) are the most commonly adopted. In Vietnam, the 1999 edition of the Red Book (hereinafter referred to as “FIDIC Red Book 1999”) is particularly prevalent due to its compatibility and suitability with the local construction market.

One of the most practically significant yet frequently disputed provisions in the performance of construction contracts is the clause on delay damages, as stipulated in Clause 8.7 of the FIDIC Red Book 1999. This article aims to analyze and clarify the legal aspects of this provision under applicable Vietnamese laws and its practical implementation.

Ngày 26/07/2025, Trung tâm Dữ Liệu Quốc gia đã tổ chức Hội nghị Tập huấn Luật Dữ liệu và các văn bản quy định chi tiết hướng dẫn thi hành tại Thành phố Hồ Chí Minh.

TRAINING CONFERENCE ON THE LAW ON DATA AND DETAILED IMPLEMENTING REGULATIONS

On July 26, 2025, the National Data Center organized a training conference on the Law on Data and its detailed implementing regulations in Ho Chi Minh City.

NHỮNG QUY ĐỊNH MỚI DOANH NGHIỆP PHẢI TUÂN THỦ

Ngày 26/6/2025, tại kỳ họp thứ 9, Quốc hội Việt Nam khóa XV đã chính thúc thông qua Luật Bảo vệ dữ liệu cá nhân số 91/2025/QH15 – Đạo luật chuyên ngành đầu tiên điều chỉnh toàn diện lĩnh vực bảo vệ dữ liệu cá nhân. Sự kiện này đánh dấu mốc pháp lý quan trọng và khẳng định sự chuyển mình mạnh mẽ của Việt Nam để bảo vệ quyền riêng tư của cá nhân trong nền kinh tế số đang phát triển nhanh chóng như hiện nay.
