📍 In the context of global integration, it is increasingly common for married couples to own joint real estate (houses and apartments) abroad. However, when deciding to divorce, the issue of dividing real estate abroad becomes a complex legal hurdle. The biggest question often arises: Which court—Vietnamese or foreign—has jurisdiction to handle this matter?

💭 According to international law and the 2015 Vietnamese Code of Civil Procedure, the jurisdiction to resolve disputes related to real estate adheres to the principle of "separate jurisdiction."

⚖ Specifically, Clause 1, Article 470 of the 2015 Code of Civil Procedure states that Vietnamese courts have separate jurisdiction over the following:
"Civil cases relating to rights to real estate located in the territory of Vietnam."

🗝 In accordance with the principle of reciprocity and international practice, when real estate is located abroad, the jurisdiction to resolve rights related to that real estate (such as ownership rights, usage rights, and division in divorce) usually belongs to the court where the real estate is located (lex rei sitae).

It is not just about agreeing on a figure; the real difficulty lies in calculating it based on international living standards and the methods of enforcing the judgment when the obligated party is outside Vietnam.

🔍 According to the 2014 Marriage and Family Law, the child support obligation between parents and children is determined based on the law of the country where the child receiving support resides.
If the child (the child receiving support) is a foreigner residing in Vietnam or a Vietnamese citizen residing abroad, the application of law will overlap. However, the general principle of the law is to prioritize protecting the best interests of the child, ensuring that the child maintains a stable standard of living as before the parents divorce.

Once a child is abroad, bringing them back is an extremely difficult, costly, and sometimes impossible process due to differences in the laws of various countries.

💡 Before attempting to take your child away, the other party often makes discreet preparations. You need to pay special attention if you see the following signs:
- Regarding documents: The other party secretly renews your child's passport, extends their visa, or tries to obtain the original birth certificate from you.

In today context of international integration, many Vietnamese citizens marry foreigners and live in various countries. However, in reality, there are quite a few cases where two people hold a wedding ceremony and live together abroad without registering their marriage in Vietnam. When the marriage faces a crisis and leads to a desire for divorce, a common question is, "Is it possible to divorce a foreigner if the marriage was not registered in Vietnam?"

⚖ According to the 2014 Law on Marriage and Family, a marriage is only legally recognized when the man and woman register their marriage at a competent authority.
Therefore, if a Vietnamese citizen lives with a foreign citizen but does not legally register their marriage in Vietnam, they will not be considered husband and wife legally.

💭 Another common situation is two people have legally registered their marriage abroad but have not completed the marriage registration procedure in Vietnam.

🔎 Conditions for Change of Direct Child Custody after Divorce

⚖ Change of direct child custody refers to a legal procedure in which an individual (father or mother) or a competent authority or organization submits a request to a Court for re-examination and issuance of a new decision regarding the person who directly supervises, cares for, nurtures, and educates a child after a divorce judgment or decision of a Court has taken legal effect.

⚖ This change aims to ensure that a child is provided with the most comprehensive environment for development in both material and spiritual aspects in cases where the current custodial person no longer meets sufficient capacity or conditions to properly perform legal obligations.

⚖ Pursuant to Article 84 of the Law on Marriage and Family 2014, a Court shall consider a change based on one of the following grounds: an agreement between the father and mother and/or the current custodial person no longer satisfies required conditions.

⚖ In addition, during consideration of a change of direct child custody, a Court shall also take into account the wishes of a child 07 years of age or older.
