Vietnam – Intellectual Property Office Announcing Digital Transformation for Administrative Procedures
On February 18, 2025, the Intellectual Property Office (IP Vietnam) issued Notification No. 438/TB-SHTT, announcing significant steps towards digital transformation and administrative reforms in accordance with government regulations.

As part of this initiative, the IP Vietnam will send all documents related to the resolution of administrative procedures in industrial property. This includes decisions, notifications, and office actions issued by the IPO since January 1, 2025 directly to the email addresses provided by applicants.

The information contained in these emails will include:

The registration number of the industrial property application
The number and date of the issued document
A link for the applicant to access the document
An automatically generated tracking code to ensure the security of the transmitted information
Applicants will have the ability to search and view these documents or download them for personal use and storage. Importantly, these electronic documents will serve as substitutes for paper versions and will hold the same legal validity.

Paper documents will only be sent to applicants who either do not have an email address or whose email communications are unsuccessful.

This transition reflects the IP Vietnam’s commitment to enhancing efficiency, accessibility, and transparency in the management of industrial property, aligning with the broader goals of digital transformation and simplification of administrative procedures set forth by the government.

📌 NOTICE WHEN REGISTERING A TRADEMARK CONTAINING ELEMENTS OF THE VIETNAM MAP

🔹 Notice When Registering a Trademark Containing Elements of the Vietnam Map. Protecting Vietnam’s sacred national sovereignty is the right, responsibility, and duty of every Vietnamese organization and citizen

Notice When Registering a Trademark Containing Elements of the Vietnam Map

🔺 According to Notice No. 7296/TB-SHTT dated August 27, 2013, issued by the Intellectual Property Office of Vietnam, trademark registrations that include elements resembling the Vietnam map must comply with legal regulations concerning the use of the country’s map. This aims to raise (awareness of national sovereignty, particularly regarding the Hoang Sa and Truong Sa archipelagos, with specific requirements as follows:

🔺Trademarks featuring the Vietnam map must accurately depict its proportions, positioning, and, most importantly, include the Hoang Sa and Truong Sa archipelagos.

🔺For pending trademark applications or existing Trademark Registration Certificates that include elements of the Vietnam map, applicants and certificate holders may request to update their trademarks to a revised version that clearly represents the Hoang Sa and Truong Sa archipelagos. No additional fees or charges are required, provided no other elements of the original version are altered.

🔺To save time and costs, businesses should pay close attention to these requirements when using the Vietnam map in trademarks for advertising, commercial, or promotional purposes.

From the date on which the registration application is received by the IPVN, the registration application of a trademark shall be examined in the following order:
- A trademark registration application shall have its formalityexamination within 01 month from the filing date.
- Publication of trademark registration applications: A trademark registration application shall be published within 02 months after it is accepted as a valid application;
- An industrial property registration application shall be substantively examined within09 months from the date of application publication.
