📅 Ngày 07/9/2026, Bộ Nông nghiệp và Môi trường đã ban hành Công văn số 10108/BNNMT-QLĐĐ về việc thực hiện thủ tục hành chính trong lĩnh vực đất đai.

📌 Theo đó, Bộ Nông nghiệp và Môi trường đề nghị Ủy ban nhân dân các tỉnh, thành phố trực thuộc Trung ương chỉ đạo, triển khai một số nội dung để khắc phục tình trạng nêu trên, tăng cường hiệu lực, hiệu quả quản lý nhà nước về đất đai, nâng cao chất lượng phục vụ trong thực hiện thủ tục hành chính về đất đai, bảo vệ quyền và lợi ích hợp pháp của người sử dụng đất, chủ sở hữu tài sản gắn liền với đất.

👥 Tại Mục 2 Công văn, yêu cầu các địa phương rà soát, lựa chọn, bố trí cán bộ, công chức, viên chức có đủ năng lực chuyên môn nghiệp vụ, am hiểu pháp luật, có phẩm chất đạo đức tại bộ phận tiếp nhận và trả kết quả với tinh thần “hành chính phục vụ, gần dân, sát dân”.

❗ Đáng chú ý, tại Mục 4 Công văn, Bộ Nông nghiệp và Môi trường chỉ đạo trường hợp hồ sơ chưa đầy đủ, chưa hợp lệ, cơ quan tiếp nhận phải có văn bản hướng dẫn hoàn thiện hồ sơ một lần duy nhất đối với các nội dung cần bổ sung, hoàn thiện, chấm dứt tình trạng trả hồ sơ nhiều lần.

DIRECTS AUTHORITIES TO END REPEATED RETURN OF LAND-RELATED APPLICATIONS — DOCUMENTS MAY ONLY BE RETURNED ONCE

📅 On September 7, 2026, the Ministry of Agriculture and Environment issued Official Letter No. 10108/BNNMT-QLĐĐ on the implementation of administrative procedures in the land sector.

📌 Accordingly, the Ministry requested People’s Committees of provinces and centrally governed cities to direct and implement measures to address the above situation, strengthen the effectiveness of state management of land, improve the quality of administrative services, and protect the lawful rights and interests of land users and owners of assets attached to land.

👥 Under Section 2 of the Official Letter, local authorities are required to review, select, and assign qualified officials, civil servants, and public employees with sufficient professional expertise, legal knowledge, and ethical standards to reception and result-delivery units, with a focus on a “service-oriented administration, close to and responsive to the people.”

❗ Notably, under Section 4 of the Official Letter, where an application is incomplete or invalid, the receiving authority must issue written guidance on all matters requiring supplementation or completion on one occasion only, thereby putting an end to the practice of repeatedly returning applications.

📅 Ngày 28/7/2026, Ban Chấp hành Trung ương ban hành Nghị quyết 21-NQ/TW năm 2026 Hội nghị lần thứ ba Ban Chấp hành Trung ương Đảng khoá XIV về quan điểm, định hướng sửa đổi Luật Đất đai và các luật có liên quan.

Theo đó, mục tiêu tổng quát Nghị quyết 21-NQ/TW năm 2026 là:
- Quản lý đất đai chặt chẽ, minh bạch, công bằng, hiệu quả, bền vững, đưa đất đai thực sự trở thành nguồn lực chiến lược, lợi thế cạnh tranh và động lực phát triển đất nước trong giai đoạn mới, góp phần nâng cao đời sống của Nhân dân, tăng cường niềm tin của Nhân dân đối với Đảng và Nhà nước.
- Hoàn thiện thể chế, chính sách về quản lý và sử dụng đất đồng bộ và phù hợp với thể chế phát triển nền kinh tế thị trường định hướng xã hội chủ nghĩa.

📍 Nguồn lực đất đai được quản lý, khai thác, sử dụng bảo đảm tiết kiệm, bền vững, hiệu quả cao nhất; bảo đảm công bằng và ổn định xã hội, bảo đảm quốc phòng, an ninh, bảo vệ môi trường, thích ứng với biến đổi khí hậu. Thị trường bất động sản, trong đó có thị trường quyền sử dụng đất, trở thành kênh phân bổ đất đai hợp lý, công bằng, hiệu quả.

📅 On 28 July 2026, the Central Committee of the Communist Party of Vietnam issued Resolution No. 21-NQ/TW, adopted at the Third Plenum of the 14th Central Committee, on views and orientations for amending the Land Law and related laws.

Accordingly, the overall objectives of Resolution No. 21-NQ/TW include:
- Managing land resources in a strict, transparent, fair, effective and sustainable manner, making land resources a strategic asset, a competitive advantage, and a key driver of national development, thereby contributing to improving people's living standards and strengthening people's trust in the Party and the State.
- Improving and harmonising the legal and policy framework governing land management and land use in line with the development of a socialist-oriented market economy.

📍 Land resources shall be managed, exploited and used economically, sustainably and with the highest efficiency, while ensuring social equity and stability, national defence and security, environmental protection, and adaptation to climate change. The real estate market, including the market for land-use rights, shall serve as an effective, fair and reasonable mechanism for the allocation of land resources.

Thông báo nhấn mạnh yêu cầu phải đánh giá đầy đủ, toàn diện chứng cứ để xác định chính xác bản chất hành vi phạm tội, phân biệt rõ giữa hành vi "Đánh bạc" và "Tổ chức đánh bạc", bảo đảm việc xét xử đúng người, đúng tội, đúng pháp luật.

Theo đó, Pháp lệnh 03/2026/UBTVQH16 quy định trình tự, thủ tục Tòa án nhân dân xem xét, quyết định việc đưa người nghiện ma túy từ đủ 12 tuổi đến dưới 18 tuổi đi cai nghiện bắt buộc (sau đây gọi là đưa đi cai nghiện bắt buộc); trình tự, thủ tục xem xét, quyết định việc hoãn, miễn chấp hành, tạm đình chỉ hoặc miễn chấp hành phần thời gian còn lại trong quyết định đưa đi cai nghiện bắt buộc; khiếu nại, kiến nghị, kháng nghị và giải quyết khiếu nại, kiến nghị, kháng nghị trong việc đưa đi cai nghiện bắt buộc.

Như vậy, từ ngày 01/8/2026, Tòa án áp dụng thủ tục riêng để xem xét, quyết định đưa đi cai nghiện bắt buộc đối với người nghiện ma túy từ đủ 12 tuổi đến dưới 18 tuổi (sau đây gọi là người bị đề nghị) khi thuộc một trong các trường hợp bị đưa đi cai nghiện bắt buộc theo quy định của Luật Phòng, chống ma túy và phải bảo đảm các nguyên tắc quy định tại Điều 2 Pháp lệnh này.

📅 On 8 July 2026, the Standing Committee of the National Assembly adopted Ordinance No. 03/2026/UBTVQH16 on the order and procedures for the People's Courts to review and decide on the application of compulsory drug rehabilitation measures to drug-dependent persons aged from 12 to under 18 years old to compulsory drug rehabilitation.

Accordingly, Ordinance No. 03/2026/UBTVQH16 provides for:
• the procedures by which the People's Courts review and decide on compulsory drug rehabilitation for drug-dependent persons aged from 12 to under 18 (hereinafter referred to as the person proposed to be subject to compulsory drug rehabilitation);
• the procedures for reviewing and deciding on the postponement, exemption, temporary suspension, or exemption from serving the remaining period of a compulsory drug rehabilitation decision;
• the procedures for handling complaints, recommendations, protests, and the settlement of complaints, recommendations, and protests relating to compulsory drug rehabilitation.

Accordingly, from 1 August 2026, the People's Courts shall apply a specialized procedural framework when reviewing and deciding on compulsory drug rehabilitation for drug-dependent persons aged from 12 to under 18 years old (hereinafter referred to as the proposed person) who fall within the cases subject to compulsory drug rehabilitation under the Law on Drug Prevention and Control, and must ensure compliance with the principles set out in Article 2 of this Ordinance.
